Send Prior Approval Notices? (H-1B)

I'm a little confused about Note 9 of the Assembly Instructions which says:

"Send copies of any prior approval notices with any new requests for extensions of stay, change of status or amended petitions."

Does this mean that I must send all of my previous H-1B approval docs (I797A) along with the i130/i485 AOS package?

If yes, then what Form must I attach all I797s to? (I'm thinking i485)

Thanks for help.

What assembly instructions are you referring to? What are you applying for--to adjust your status? You haven't given enough information.

I saw "Note 9" while reviewing the assembly instructions on the VJ website:

http://www.visajourney.com/content/assembly

Note 9: Send copies of any prior approval notices with any new requests for extensions of stay, change of status or amended petitions.

The same directive can also be found on uscis.gov under "USCIS - General Tips on Assembling Applications for Mailing"

The package being filed is a concurrent i130/i485 with i765, other forms (i693, i864, g325a USC, g325a alien), and supporting documents. My wife's the petitioner, and I'm on H-1B.

I don't see anywhere in the i130/i485 form instructions where copies of prior approval notices need to be submitted. However the assembly instructions Note 9 appears to suggest otherwise. Hope this helps. I'm not sure how to handle this one.

No, you don't need to send your prior H1-B notices with I-130. That instruction refers to extension of status, change of status, or amended petitions, so it doesn't relate to a new I-130 petition. For example, if you were applying for a renewal or extension of your H1-B status, you would want to send your prior H1-B approvals.

I-485 is an "adjustment of status", not a change of status, which is why that also isn't covered by that note. Change of status means changing from one nonimmigrant status to another (i.e., F-1 to H1-B).

Thanks! This explains alot ... very interesting how 2 comparable words (adjustment/change) mean 2 significantly different things wrt the immigration process.
