Timeline

I have a big question.

We are getting married.

I am from Mexico. She's a US citizen.

I am going to be on a visitor visa (B1-B2) at the time of the wedding.

Do I have to get a K-1 visa if I am already within the US or is there any other way that I can get a Permanent Resicency.

Please We are not sure what to do.

It is not fraud to enter with a visitors visa and get married. It is only fraud if you enter with the visitors visa with the intent to immigrate. You can come and get married and then leave again and get the proper visa to immigrate.

It is not fraud to enter with a visitors visa and get married. It is only fraud if you enter with the visitors visa with the intent to immigrate. You can come and get married and then leave again and get the proper visa to immigrate.

And of course once you are married a K-1 visa is no longer your route as that is a fiance(e) visa. You have other options such as K-3, DCF, IR1/CR1 and there are plenty of people here doing those filings

If you are living in the US and did NOT plan to get married and mmigrate when you entered, you can file to Adjust Status from within the US, (without leaving) based on the fact that you are married to a US Citizen (this is perfectly legit and legal).

You DO NOT need to leave and apply for a VISA from your home country (though many people will tell you either should or have to).

It's kind of a touchy topic.

Probably it would be a good idea to consult a lawyer.

Timeline

Entering the united states on a visitors visa and getting married is something that people are doing all the time. This is one of the most popular ways of marriage into the states. You do however have to prove that this was not your intentions. It's against immigration law to enter the united states with the intentions of getting married on this type of visa. But people succesfuly are doing this all the time.

Me and my fiancee chose to do things the right way as to not have to fear the worst at the interview. We didn't want something going wrong at the interview and for my fiancee to be BANNED from the united states for a certain amount of time.

You would be lying at the interview if you shose this way of getting married. I don't think you should take this kind of risk for the person you love. EVerything would work out fine doing it the right way. But if you did chose to take this rout you would be filing for the K-3 spousal visa and not the K-1. You can check the other forums on how to do this.

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)
