Bollocks.

The answer is "either". It depends on your circumstance.

The realistic answer for most returning expats is they must go home and first find a job.

However, if the British citizen has been earning above the UK minimum in the US for the 12 month period prior to your return, AND the British citizen manages to get a job in the UK BEFORE their return which pays the minimum, AND the British citizen will start that job within 3 months of your return, THEN you can return together.

Oh--and the UK citizen's new job MUST be in the same field as the previous one too. I wonder how they determine that, what kind of latitude they give...

So...our infant son, a US and UK citizen can move over with daddy a UK citizen. But mom has to stay in the US until dad makes 18600 for 6 months or can show a contract that he will be making that. Beyond the fact that I can work in London in the UK branch of our office given the right transfer...except now I have to have the right degree to do that?

You can see if you can get a visa to work over there by having the company sponsor you too. With the way the economy is, it might be hard to do this.

The company would have to be registered with the Home Office as a sponsoring entity. And your occupation would have to be on the shortage list.

A friend of mine (UKC stay at home mum) who lives in Japan married to a Japanese man has just realized they could not return to the UK together and pointed this out to me

I believe Trompe's friend and the author of the petition are not the same person, merely similarly wed to a Japanese man. The author is in the UK, and Trompe's friend is in Japan.
