For those of you following this, the Home Office appeal against Justice Blake's decision in the MM case was heard in the Upper Tribunal on March 4th and 5th.

Justices sitting the case have indicated a decision within four to eight weeks, noting time is of the essence due to the HO having placed hundreds of application on "pause" since July.

HO has also indicated it will appeal an adverse decision to the UK Supreme Court.

I read this to be an increase in the salary limit for non-EU skilled workers to come in. Not an increase on the threshold a British citizen must earn to bring a non-EU spouse back home. If you have a link to other news, please do share it. It's important.

I do believe it is vital for all Brits away from home to follow this situation. I spend very very little time at VJ lately. I read other boards though especially those of Brits planning a return to the UK. I am not exaggerating when I report that (at least weekly and more likely several times a week) I read a thread by a British citizen who can't believe what they are reading about the 2012 rules. Many feel exiled now.

Anti-immigrant sentiment is as high as ever in the UK. The result for Brits trying to return home are many new rules and regulations even if they don't have a foreign spouse. You can access the NHS pretty much immediately once you've proven habitual residency. But you'll not receive any help with housing or benefits for at least three months.

Anyway, I'm glad to see readers are still following this thread and I appreciate that it remains pinned. I know when one moves continents especially in a spousal relationship, they tend to think of it as forever. But the world is changing so much. Gone are the days wherein the family of a migrant sent them off to foreign shores, never to see them again. Travel is cheaper, technology makes communication with family and friends easier, and the world is generally more global. Especially in partner relationships of people from two first world countries, they may want to move because of career, because of health reasons, or even just for a different climate. I found out that one should never say never when it comes to moving around. We will be ten years married this fall. We'd like to have the option to go back to the UK. But for now, we wait.

The MM court case wherein the government won the last round has been granted appeal. There is no date yet when arguments will be heard but it is thought things will be protracted. Expect no movement on rule changes for at least a year.

You seem to have nicely skirted around the issues and the current and likely future reality.

One thing I am certain of that none of this has to do with UK USA movement.

One thing I am certain of that none of this has to do with UK USA movement.

Boiler, it does have to do with couples wanting to move to the UK. People sometimes decide to do this after having lived together in the US for a while.

The issues are best left to the politicians.

The current reality has been established.

The likely future is up to the courts.

This isn't a thread to get into an argument about migrants in the UK.

It's posted here so people know what they are getting into before moving over to the US.

No clear details yet...but they are at it again!

Seems to relate towards those seeking work type visas in the UK from outside the EU, and not spouse/family types... but you know he won't give non-EEA immigrants a break there either. Hopes are on the appeal for that. I've been scanning support groups for indication that it was directed towards family, but have not seen any mention of it.

I honestly just thought if after living in the US for X amount of years, if I'm truly missing home, or my Mum becomes ill or something, I could just move hubby & the kids (if any) back to the UK?!

In principal it is similar to most countries, if you want to immigrate legally you need to be sponsored.

Or head for Calais.
