Hi All.

I have been in the US for around 8 months, arrived under cr-1 and will needt to apply for ROC in may 2013 and have been looking at the next steps in our process...I-751 is clear enough and obviously want to go for the n-400 stage when it is time, however I have seen that they want to know of motoring convictions and I have 3 in my whole driving life of 23 years+ one of which I had completeley forgotten about simply because it was my stupid years at the age of 17-18 and was recalled when I asked for my driving record from the UK...2x speeding fines, but the other gives me concerns and is worrying me sick...I was stopped without a full licence, insurance and MOT certificate and unaccompanied driver as I was moving the car I had bought as a project, which I had the option of appearing in court or allow judgement, which I allowed judgement and pleaded guilty. It was a matter of points and a fine of around 400 pounds back then....1982 i beleive it was.

How do I approach this now? Now this has come to light do I tell them now or wait until ROC and send a letter explaining the circumstances? I am arranging to get the entries from the UK and any file that may exsist.

Advice appreciated.

I don't think that traffic violations need to be reported unless drugs or alcohol was involved

My husband had a similar conviction from the early 80s, when he was in his early 20s - driving with false MOT document/receiving stolen property (the MOT certificate) and attempting to deceive the Police. He was fined GBP100 or so. He reported it on his N400 form (mainly because looking back at his 20 year old Green Card application he saw it had been mentioned then) but did not send any paperwork because the fine was under USD500. They wrote asking him to bring the details to his interview so he applied for a UK Police Certificate - the same application I used for my visa. That came back showing No Trace (or possibly No Live Trace, I can't remember) and he took it to the interview. They asked him about the incident and took the Police Certificate but it was pretty much a non-event and he was approved on the spot.

I would say just be honest about it but I'm not sure you can do anything until you file for ROC as I wonder what they would do with that information at this stage - is there an open case?

Apologies for posting in the wrong section in the first place and thanks for moving to the correct forum.

The only open case is the current process, I am in my first year of my conditional 2 year GC or PR status and will be applying to Remove conditions in may of 2013.

Just didnt know the best way to report this as its just come to the forefront now.

I think that you have to report all arrests.

You mean speeding tickets also count when we file I-751? Seriously? I mean anybody can have some tickets in their life :wacko::wacko::wacko: But what for? I thought the main thing to do when we file I-751 is to prove a bona fide marriage.

Apologies if I have confused the topic but I was referring to the N400 form (citizenship) as the OP said that he would be applying for that down the road. I'm a year or so away from the I-751 so I haven't looked in any great detail at that form.

Having said that, I did say that I believe that you have to report all arrests and I don't think you generally get arrested when you get a speeding ticket.

Maybe I meant active case rather than open. I'm just not sure how you would go about reporting it now so I think I would personally wait until it was time to file ROC.
