Hi, I used to live in the USA illegally but left a month before I became 18 to live in Mexico (so the ban doesn't apply to me) because I didn't want to be in a country illegally. My parents still live in the USA (illegally) along with my brother who is a US Citizen by birth.

I want to apply for a US Tourist Visa to visit friends but I am worried that applying could get my parents involved in any of this. Is this something I have to worry about?

I am trying to wait until I enter college (I lost a year because of the transition to Mexico) so that I can show I have some reason to return. I also have other things to show them.

You can certainly try to apply for a tourist visa, but even without the ban, you may have a difficult time getting one since you have both parents and your brother in the US. You'll have to prove to the CO interviewing you that you have strong ties to Mexico and that you will return on time. They won't send agents to your parents' house though.

Your tourist visa will be difficult, espeically since they probably already know you've been in the US illegally - or if not, can deduce from your lack of ties to Mexico.

Plus, don't you think USCIS and ICE are too busy to deal with YOUR parents simply because you put their names on a tourist visa applicaiton?

Your reasons to go to the US are irrelevant, your ties to MX are the most important

Good luck

Yeah, I plan on pushing the "If I wanted to live in the USA, I wouldn't have left" idea strongly.

You don't have a bar, so there's nothing legally to prevent you from getting a visa except insufficient ties to Mexico.

Focus on your life now in Mexico. An apartment lease, steady job, ongoing higher education, car ownership.. Basically anything you could show that would compel you to return and not stay illegally again. I don't know if your history will work with or against you here. The fact that you left voluntarily, on your own account before 18 at least shows you were willing to stick to the rules once old enough to understand them and consent, even though it must have been difficult to leave your family behind.

How long have you been gone?

It might be a but early, but no harm in trying.

Have relations illegally presence is a big hurdle to overcome as well as the ties issue.
