Is anyone else already in country and filing a change in status with a I-131 AP by chance? I'd LOVE to pick your brain on how you're answering some of these questions that may not be applicable due to the Canadian Visitor Entry!

Most of us who have been through AOS have - what's the question? You can probably ask in the AOS forum where everyone is in the same boat.

We are applying for a 1-Step and he was admitted on a visitor visa before marriage. Do we enter "Visitor" or 1-130 or???

Class of admission means what did you enter the USA on.

You didn't enter on a I-130 =)

You would put Canadian visitor. Or something of the like.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

If there has been an overstay then it's not advisable to leave the country and then try to re-enter using Advance Parole document. Even if there hasn't been an overstay, but just a lengthy stay since his last entry, he is taking big chances. In other words, there may be no point in filling out an I-131 form. You may want to check the AOS From Other Visas forum or the Working and Traveling forum for situations such as yours.

Nope, no overstay at this point. We actually haven't even gotten married yet! We're eloping next week! I'm just researching everything. We met with an attorney that advised us that we have a great case for everything, but we need to act quickly and get it all filed AS SOON as we get married. He's been in country for 4 months and had no intent of getting married at his entry.
