I past my intrveiw is 4 month now and i got this last week

Post Decision Activity

On June 2, 2012, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

not at all !

the case is under review at the USCIS office. This is NOT AP.

mozmoz - now ya wait.

There are 3 possibilities:

1. IF the USCIS office decides that Visa Officer was wrong, and the entire content of the casefile was sufficient, then the I-130 petition will be re-affirmed by USCIS, sent on to NVC with the re-affirmation, then NVC will send it on to the IV Unit for another interview.

2. IF the USCIS decides that they MIGHT re-affirm the petition if the USCitizen Petition sends in more information, then the USCIS office will generate a letter to the USCitizen Petitioner, asking for more things. There will be a list. If , the stuff she returns to USCIS is found to be sufficient by USCIS, the petition will be re-affirmed, sent on to NVC, who will in turn send it on to the IV Unit. OTOH, if, what she sends in is found to be insufficient, there's great chance that the USCIS office will uphold the Visa Officers decision, and the Immigrant Visa Application will be sent on, with a recommendation to deny the Visa Application and Petition for Application.

3. If the USCIS decides that in the totality of the casefile, including the casefile notes from the Consulate Office, warrant a denial, they will write the USCitizen Petitioner with the results of their findings.

There is a range, from 2 to 18 months.

back to my 3 possible paths, though?

1. 2 to 5 months

2. 2 to 11 months for the next interview

3. 2 to 3 months.

Took us 9 months to get a response from USCIS, and it was a Notice of Intent to Revoke. We were given 30 days from date of NOIR to respond. By the time it got to our house, we had 24 days to respond.
