hello i want to know if IRS has a limit time to pay taxes or they can fill after april

because my husband filled tax of 2011 after april 2012 can this create for us a problem because in the day of interview they will ask me about last tree tax return???

my second question is my interview will be in decembre 2012 can consulare officer ask me for tax of 2012???

It is o.k if you file your taxes late if you have an extension (that is if you file after April 17, 2012 for the 2011 tax year). However if you are getting a refund you don't need an extension and you can file after April 17th. And no they can't ask you about 2012 return if you are interviewed in December 2012 because you are not required to file 2012 taxes until the first quarter in 2013.

1. usually, FILE within 3 years without penalties accruing.

2. yup, anytime.

3. that's ok.

4. If nothing is done, absolutely. Do Something, from my prior advice to you? you'll be ok, he'll be ok.

5. yes, you will be asked. not have 3 years? then show signed letter of attestation from husband as to WHY he not have 3 years of tax return info.

6. No - as that's a different tax year, filed in 2013.

first thank u so much for your replay he help me more than asking consulate i want to know plz when exactly consulate will ask intervewers about tax of 2012 in wish month in 2013 they will ask for tax of 2012??

mostly, i understand you.

i dissect your words so i can focus on the answers.

for tax year 2012, income accumulated in 2012, the tax filing season is from mid january till mid april, 2013.

If you interview in december 2012, he won't have any tax return for tax year 2012.

however, on the I-864, is a spot for 'current annual income' which is NOT for income tax return info,

instead - that's for (in your case) 2012 income information.
