hi all just need to get some information im from the uk and want to marry my girlfriend from america then hopefully move to be with her im wondering if i can go out on a visotors visa (b-1) get married and then apply for the k-3, i-130, i-129 while still in the us? a change os status? any info is very welcome thank you shaun

Well, I'm glad you stopped VJ. No you cannot enter the US on a tourist visa and change your status after you marry your girlfriend. That is visa fruad

No more K3 either

What you CAN do is travel to the US, marry, and then leave when your authorized stay is up.

Read the guide, after you are married in the US, you can file while you are still there, but you also must leave

hi guys thank you so much for replying :)canadian_wife can we marry and file the i-130 while im there??? then leave and wait for the cr-1 ?? is it? its very confusing :S it gets very hard all we want is to be together :( lol but we are willing to do what ever we must thank you again so much for your help

The I-130 gets you the CR-1. I think you may be confused.

I-130 is the form the USC petitions with for a spousal visa.

CR-1 is the visa that is stamped into your passport after your interview in your country.

Yes you can file the papers while you are still in the USA.

The fraud is the intent to adjust status after marriage.

Yes, so your plan should be thus

Fly to the US and use your tourist visa to enter

Once admistted, marry

Once married, file the I130

Leave when you are supposed to, as in when the CBP tells you to

Return to UK

Medical in UK

Interview in UK

Fly to US and enter on your Cr1 visa

Cool?

that sounds like a plan :) is there any indication on how long i would have to come home and wait for? also having the cr-1 does that granted permanent residency and what about working?? im sorry im such a newbie at this its all very confusing many thanks shaun

You would get a green card when you enter the USA and activate your CR-1. That allows you to work right away and travel right away.

They will stamp your passport on entry - this will act as a temporary green card until yours arrives in the mail shortly after.

I'm not sure how long it will take the UK to have your interview and stuff. Have a look in the UK regional forums, you can find information specific to your country there. Such as how long to expect to wait, where to have the medical done, when to do certain things etc.
