Oh and @Sweetcheeksss

- I just now noticed that they eventually made it so you did not need a waiver (after what sounds like alot of headache). How long did that whole process take with them getting it corrected and for you to get your visa?

Just looked at my Order Against Offender document again, it says:

"On or about 26 of January 2001, at or near Vancouver British Columbia, did unlawfully steal a value not exceeding $5000.00, property of XXXXXXX, contrary to Section 334(b) of the Criminal Code of Canada. Crown proceeds by Summary Conviction. And it was ordered and adjudged that accused plead guilty, Conditional discharge, probation - 6 months, mandatory victim surcharge waived".

So, my point is, even though I was CLEARLY charged with a summary offense and I should have fallen under the "petty theft exception", I STILL had to hire a lawyer and fight the officers waiver recommendation.

I had my interview in August, I had my visa in hand in January.

And that was with the Visa Chief helping us AND we had an approved expedite (my husband was deploying to Afghanistan).

He had his senator helping us too, but once it got into the waiver issue, they could no longer do anything because it became a legal thing.

Well guessing I will just have to keep our fingers crossed. If they tell him the same thing that the guy told you I wonder if there is anyway asking to speak with someone above him right then or if that would just make the interviewer angry :(

Truthfully, I didn't feel like I could have asked. He interviewed me, made his decision that he was going to deny me and that was about it. He was FAR from friendly lol. And he didn't want to answer any questions, he just left the little room after he gave me my denial letter.

Hopefully you won't have any issues. Mine cost us almost 8k to get straightened out but I don't regret it because I could still be waiting for my waiver to be approved. We didn't have any hardships so I doubt we would have had our waiver approved.

Well I know we wouldn't be able to afford a lawyer but I'm in the same boat as you as far as not really having any "extreme" hardships that we could use.

I figure if the guy (or lady) tells him he needs a waiver I will speak up. Heck if hes already denied not much more then can do to him. I will make sure to bring along the law printed out and the whole joyriding is not a CIMT thing and ask to speak to someone and hope to not get arrested or something LOL :)
