Dui not declared in i-485 adjustment of status appl

Hi guys,

Thanx for all your input in here. I have been enjoying the threads while gathering invaluable info from all of your experiences then suddenly it dawned on me: ooooopssss!

I filed my n-400 last month: may 17 noa, june 12, tuesday will be my FP. Phoenix lockbox, Los Angeles, local office. I had a DUI back in 2001. In Jan 2008, i filed my i-485 and thru my dumbbells(dumbness) i failed to check the arrest box because a friend of mine said it was not necessary( nice advice :) ) i am married to USC. The application was approved. In 2008 i got my temp GC & last year i filed i-751 ROC & checked the arrest box. I got the 10yr GC again. I filed n-400 last month based on a 3yr marriage & checked the arrest box.

Am i in deep trouble for not declaring the arrest for my DUI in my very first application (i-485) ?

I already have accepted a denial outcome due to lack of good moral character out of it :(

Hard to say. The USCIS has 5 years to revoke a decision regarding the GC so technically you could be in trouble for it. However, the last decision (I-751) was taken with knowledge of an arrest so there is not really much ground to revoke the decision.

My guess is the fact you didn't mention it on you I-485 will probably not matter as much. The DUI itself might take some explaining though. It is more than ten years ago so you will probably get your citizenship. Be nice and honest to the IO is the best advice there is :)

I wouldn't worry about it. You amended your form for ROC. They didn't ask about it. If they ask about it at interview you amended at ROC. I really wouldn't be concerned at this point. DUI isn't the end of the world.

I agree with you on just being honest to the io. Thanx Manu!

I wish i can read another input from someone who had done the same thing; or if maybe brother ezekiel can give me an insight from a standpoint of an io who just had a really bad day ahaha :)

They never asked me about it on our first interview. Then it took almost two years for them to give me a decision for the i-485 so they interviewd us again & they never asked about it. I was given the temp GC subsequently. I gave them an explanation in my roc and another letter of explanation for the DUI in my n-400 apllication but i never mentioned about forgetting to check the arrest box in my i-485.
