Our AOS interview is coming up shortly and I’ve read many times on here about how they take away the EAD at the interview on approval. :P

If our AOS gets approved pending an FBI name check do I get a Stamp in my passport showing an approval or am I allowed to keep my EAD until the name check is done. I’m worried about having no documentation and starting a job.

OR

If I’m approved and told the Green Card will be mailed what happens if I get a job in-between? e.g AOS interview and no stamp in my passport then I start a job before I get the green card in the mail.

Unlikely to occur events but I’m just trying to be ready for everything. I’ve applied for dozens and dozens of jobs, I’m just trying to be as prepared as I can just incase I start a job without having all the documentation needed to fill out an I-9.. Green Card, EAD or Stamp in my passport. :hehe: I’m worrying over nothing, I’m sure.

If you are 'approved' pending name check, they don't stamp the passport. They let you keep your EAD and AP documents. Because effectively you aren't really approved.

Some offices don't stamp the passport even if the check is done and the petitioner is approved. Have you researched to see what the typical practice is for your office?

If your office is in the habit of stamping the passport and taking the EAD, I suppose it wouldn't hurt to express your concern to your AO. All they can do is say 'no'.

Why don't you photocopy your EAD (in color if possible) before the interview. And make a copy of your appointment letter (they keep it when you check in). That way, if all goes well at your interview, plus you find a job before the card comes, you could show both copies to a potential employer. The date of the interview showing on the letter would back up your explanation of why you don't have your 'real' EAD any longer. In my opinion if they really want you for the job, they'd probably take those docs till the card actually arrives.

We were able to keep our EAD card. I would check it people from your service center as rebecca suggested. Good Luck

They asked to see our Lucero's card and then cut it up in the trash can. After the interview when I expressed concern about no stamp or EAD card the lady promised we would get the card soon.

The lady was right. We had the card in a week or 2.

Rebecca is correct though. Any employer that wants you to work for them would look at your copy and listen to your story. They have a little time before they have to send the legal paperwork to the government.

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

Excellent, Thank you all for your responses! :D

I wasn’t too sure if photocopying immigration documents was allowed or if it’d look bad to an employer. Anyway looks like I’ll have a colour copy of my EAD and appointment notice made today and keep it ready just incase. With some luck I shouldn’t have any problems with AOS and should get an approval next week. :)

I can’t imagine my name creating that many hits, although my first name is quite common back home but my last name and first name together don’t appear to be common at all. :huh:

Well, as the portion of the check that causes the greatest delay is the domestic one, it's actually how 'common' your name might be in America that can slow you down.

My husband tells me his name would not be that common at all in the North. Over here it's common as grass.

They didn't take my EAD card, but didn't give me a visa stamp either. I was "approved", no name check pending.
