hi, i live in the State of Indiana and i'm curious if i can work and drive even if im still processing my Adjustment of Status. Do i need to wait for my Greencard before i can work or SSN is enough? I got my SSN though but need to change some information because i want to use my husband lastname on the card instead of mine. We are planning to go to SS office tomorrow and have it change. Does anyone have the same problem like mine?

You need Employment Authorization Document to work, did you apply for EAD when applying for AOS?

Did you file form I-765 when you filed form I-485? If so then you need to wait until you have the EAD.

That is a wise thing to do. :yes: You don't want to cause problems when you go to the AOS interview working with out authorization can be a bad thing. You can do volunteer work though as long as you don't get paid for that work.

EAD can be a waste of money unless you live somewhere that the local field office is known to be very slow, and you want to get a drivers license, or work right away, knowing that an AOS interview can be a long time off.

wonder how long will it take for AOS interview if we submit our papers this month?

ooppss.. another problem is, does anyone knows where to find an updated USCIS form of I-864 or affidavit of support? Two things the form is not expired, That's the date of the OMB authorization to collect information with that form under the Paperwork Reduction Act expires. Not the date the form expires.

I took the time and posed the question to USCIS about their website:

First on form I-864, I-864A and I-864EZ indicate EXPIRES 09/30/06

And Second the website indicates that I-864, 864EZ and 864A with edition dates 1/15/06, 11/05/01, 9/26/00, 1/21/98 also acceptable through 10/19/06. The current expired forms are 1/15/06 edition.

So are all I-864 forms un-acceptable after 10/19/06, or will there be a newer form and an update to the website?

Many of the people in a support group I am involved in are confused by this.

Can the website and forms be updated to stop the confusion?

Don’t worry about the expiration date. The series of I-864 forms with the 01/05/06 edition dates should be used by applicants. USCIS is accepting these forms and will continue to do so until the forms are revised at some point in the distant future.

Two things the form is not expired, That's the date of the OMB authorization to collect information with that form under the Paperwork Reduction Act expires. Not the date the form expires.

I took the time and posed the question to USCIS about their website:

Hey Dan, that is really a great help. Thank you so much for taking time to get answers on my questions. I really appreciate it. Now we can fill-out the affidavit of support without worry and hope to submit the AOS within this month. :)

btw, hope your fiancee get her paper soon too. Good luck to both of you!

I'll give you the original. LOL

OK if you entered the U.S. as a K-1 and have been here 76 days you will need an EAD card to change the name on your SSN record to your married name and be issued a SSN card in that name.

However, if you just want to correct the name on your SSN record and not be issued a card you can do that if your marriage certificate has your age or date of birth. Then just ask for an SSN Verificate Printout to give you some proof of the name change until you are eligible to be issued an SSN card in that name.

DO NOT DO NOT give them your SSN card until you are issued a new one no matter what they say. Tell them the dog ate it. LOL

Only the marriage document (foreign or domestic) is needed if it meets the following criteria:

-- The new name can be derived from the marriage document, i.e. bride takes the groom's last name, groom takes bride's last name, compound name (with or without hyphen) of each spouse's original name for either or both parties.

Note: State law must also allow the type of name change wishing to be made

-- The marriage occurred within the past two years

-- The marriage document shows sufficient identifying information, e.g., biographical data such as age, date of birth or parent's names, and

-- The identifying information matches the information on his/her current Social Security number record.

The applicant will need to submit an identity document in the old name along with the marriage document if:

-- The marriage occurred within the last two years and has biographical information, e.g., age, date of birth or parent's names which does not match our records, e.g., the SSN record.

-- The marriage occurred within the last two years, but does not show biographical information, or

-- The marriage occurred over two years ago (with or without biographical information.)

The identity document used to establish the old name must match the name on the current SSN record. The identity document is acceptable even if over two years old or expired.

4. Correcting Numident Data When a Replacement Card Cannot Be Issued

If the alien does not provide evidence of work authorization or a valid nonwork reason, explain that no replacement card can be issued.

Although a replacement card cannot be issued, the Numident can be corrected if the alien has provided documentation supporting the change (e.g., a name change).

If the alien provides documentation supporting the change, process the SS-5 to update the Numident information but suppress the issuance of a card. (suppress issuance of the card, and see RM 00202.320 for providing SSN Verification Printouts.)

Hello mdyoung!

i got here on a K-1 visa and filed my SSN after 3 weeks and got it after a month. At first they don't want to issue an SSN for me and the SS officer did asked for my EAD but i told them that i don't need to have EAD to apply and told them the document about Employment Authorization for Non-Immigrants (https://s044a90.ssa.gov/apps10/poms.nsf/lnx/0100203500). The relevant portion is Section C, which states that K-1 visa holders can apply for an SSN even without specific authorization from the INS. The only documents i know that are needed when applying for SSN or name change are:

1. SS application form

2. passport with US visa

3. valid I-94 card (should not expire within 2 weeks)

4. birth certificate

5. marriage certificate (if already married)

6. EAD card (if I-94 card already expired)

The only documents i know that are needed when applying for SSN or name change are:

5. marriage certificate

6. EAD card

These are what you need now if your marriage certificate has your age or date of birth.

Based on your arriving here July 25th you have been her 83 days, so you need an EAD card or the I-551 stamp or card to be issued an SSN card in your married name, but as I previously posted you can get the name on your SSN record changed with just your marriage certificate if it has your age or date of birth, but you will not be issued a card.

Then once you have an EAD card or I-551 stamp or card you only need to apply for a replacement card, since the name on the record has aleady been corrected.
