Affidavit of Support Question

Hi there,

Just a little background on our application process: I filed the I-130 Petition for my wife and it has been approved and passed on to the NVC. I received an email from them asking us to establish an agent for communications with them as well as for paying the Affidavit of Support processing fee and are waiting for the packet from the NVC.

So since I'm currently working in Singapore and plan to move with my wife to the US, I will probably have to change jobs. I hope to have employment secured in the US before we leave but in the worst case I would have to quit my current job, move to the US, and start looking for a new job once I'm there. In my case, do I need a co-sponsor for the affidavit?

Yes, you will need a co-sponsor, or to sponsor on assets. Even if you have a job offer in the USA, that will not count, you need to be actually working.

I agree, I'm pretty sure you need to be working when you file in order to qualify.

No, the law does not recognize offers of employment in place of the I-864.

A job offer may show ability of the applicant to overcome ineligibility as a public charge, but does not meet any I-864 requirement.
