i 130 denied after second interview

how shall i start. well we got married in 2008 , filed in dec 2008. i 130 approved in 2009 and sent to casablanca for interview. result is denied visa and case was sent back to the uscis. when we send additional proof, they were not enough for the uscis which affirmed the consular decision to deny the visa. then we took the case to the immigration court

of appeal which affirmed the case and sent it back to the uscis which affirmed it and sent it to morocco.

then my husband had a second interview a couple of days ago . however, they did not give him the visa. the problem is that they did not ask him to bring any evidence at all. i am at shock. i do not know what to do. if anybody has any idea or know what will happen again and how long it will take , i will appreciate it.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

January 28, 2014: Production of new Green Card ordered

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

What exactly happened at his interview? You need to be very clear about this so someone can help you understand. ANd what do you mean by they didnt tell him to bring any evidence? Did he bring any with him at all just in case?

Do you have a large age difference? Have you been back to morocco since you got married?

THE DENIAL JUST HAPPENED 2 DAYS AGO SO I DO NOT KNOW THE REASON WHY.MY HUSBAND SAYS THE INTERVIEW WENT FINE. THERE IS NO AGE DIFFERENCE BETWEEN US. HE IS 2 YEAR OLDER THAN ME. BESIDES, WE ARE BOTH MOROCCANS. I HAVE VISITED HIM LAST TIME AND STAYED 2 AND HALF MONTH WITH HIM. I DONT THINK SHOULD BE AN ISSUE BECAUSE ONE OF THE REASON THEY DENIED HIM THE FIRST TIME IS BECAUSE I DID NOT VISIT HIM. FROM MY UNDERSTANDING, THEY CAN NOT DENY YOU A SECOND TIME FOR THE SAME REASONS. AS FAR AS DOCUMENTS, WHEN THE CONSULATE CALLED HIM FOR INTERVIEW, THEY ASKED HIM TO COME AND NOT TO BRING ANYTHING.

MY QUESTION, IS THERE ANYTHING I CAN DO WHILE THE FILE IS STILL IN MOROCCO. BECAUSE IF THEY SEND IT BACK, I DONT LONG HOW LONG IT GONNA TAKE.

Please stop "shouting", ie typing all in caps, it makes your posts difficult to read.

To help, and suggest what to do, we need to know what exactly happened. How many times did you visit between the first and second denial? How did you get your cisizenship? Have you petitioned for anyone else before, or was he petitioned before?

They can deny twice for the same reason if the problem still exists; the visits were not the reason in itself, but they go towards "bonafide marriage". So for example if you only visited once before the first denial, and only once between the first and second denial, they can argue that you must not have a real relationship if you only wanted to see eachother so little. Or if you only communicate once per week, or if none of your family went over for the wedding etc...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Once of the best tools for looking for what happened is creating a transcript of the interview. If your husband will list all the things he had with him. Then he needs to docuement everything that happened from the time he entered the ebmassy to the time he left. It will help us help you and will help any legal respresentive you aquire later.

This will not be over quickly. You will not enjoy this.

i went to morocco once after the marriage and stayed with him for 2 and half time. before i could not go because i lost my job because of recession and each time i get a new job i have to wait a probation period before i could travel. but once i got a chance i did. the traveling thing was a reason he got denied in the first interview.

my question is: is there anything i can do so they can review my case in casablanca before they send it back. can i request the head of immigration to review it again. do i have my lawyer to call them and ask for a review ? or is there any option that they can look back at the case again at the consulate before sending it back.

p.s . i have sent a request to the consulate for the reasons of denial and an other request to review the case. if somebody had or know of the same case : denial the second time , i would like to know.

I know you stated the embassy told him not to bring anything but did your husband bring any new evidence with him to his 2nd interview? Such as proof of your other visit? Any new correspondence since the last interview?

If they told him not to bring anything it almost sounds like they already knew they were going to deny him. You need to get a clear picture of what happened at the interview. What questions were asked, etc. Your husband said the interview went fine, but maybe that is only his understanding and if you are able to know everything that happened you might understand differently. About keeping it in Morocco, I'm not sure what the procedure is, but there are many women here that are knowledgeable about that. Good luck to you.
