hello VJers i don't know if this is the right forum to post this but i really need your advice, this is not about me but about a friend that really need help and advice now, here's the story, my friend is under IR1, last week of last month we were so excited in our group talking and so excited about her flight, she supposed to fly going to US last june 5th, her husband was telling her he's going to send her money so that she have enough for her flight, they were both so excited her husband told her he's going to carry her at the airport and will spend the rest of his life with her and grow old with her, BUT a week before her flight her husband suddenly died, her world turned upside down she didn't know what to do and still don't know what to do now, i felt the pain she felt she wanted to hug her husband but can't, after 2 days she flew to US instead of june 5th so that she can see her husband, but it took few more days before she seen her husband, the question is i know she will be getting 10 years GC under IR1 visa, but her visa will expire on August 19th, now that her husband is dead she don't know how to get her GC, is it automatic delivered to her after few weeks or in definite time? or is there another process before she gets her GC? what if her visa expires and she didn't get her GC yet what will happen to her? she really don't know what to do and her mind is really messed up plus she really don't know anyone there in US, plus she can't get online because there's no internet on where she is now, only a common friend of us is telling me about her situation, i don't know what to answer to her question that is why i posted here, please i am so worried about her and i know she don't know how to face life now alone :( thank you in advance.

Just reading this breaks my heart. That is so tragic! I am sorry I have no advice as I am fairly new at this too but I am sure someone will be able to point you in the right direction or will at least give you some possible avenues. I will say a prayer for strength for your friend.

Just reading this breaks my heart. That is so tragic! I am sorry I have no advice as I am fairly new at this too but I am sure someone will be able to point you in the right direction or will at least give you some possible avenues. I will say a prayer for strength for your friend.

She has effectively got the greencard, as a stamp on the visa page on her passport- the physical greencard will arrive at the US address she gave in the paperwork in a few weeks. What I am not sure about is if she was "allowed" to use her visa to enter the country, as at the point she entered, her husband was dead. There are special rules for widows, but I am not familiar with them, hopefully someone else will come along and clarify.

The other thing... I am sure you want to trust what she says is true, but no internet in the USA? She can go to any library to go online.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

thank you for the reply, i really don't know what is happening with her now, since she got there in US i haven't heard anything from her, only from our friend, before she left Philippines she told me that the US embassy was working on her docs so that she can leave sooner than June 5th, yes too bad :( she is from a province here and really don't know what to do or where to go. her husbands Family is away from her husbands place, so she can't really rely to them, but thank you so much to your reply :) it gives me some idea,

Sorry to hear that sis...That is very sad.... Even her visa will expire on August 19, still her visa is good for 1 year prior to Port of Entry. That's what the Immigration Officer at the airport told me. Sorry to hear that sis...That is very sad.... Even her visa will expire on August 19, still her visa is good for 1 year prior to Port of Entry. That's what the Immigration Officer at the airport told me. Her GC and SSN will arrive at his hubby's address(more or less 1 month) Nothing to worry sis as she don't have anymore paper works to do or to process as long all entries at her GC at SSN are correct. Condolence to her and the rest of the family members

the process of petitioning is already done. the beneficiary is now in the US so I believe she is now married to the usc therefore whether the usc is dead or not, she is entitled to her gc. There will only be a problem if after marriage the usc died without filing (file a petition) for the wife's gc but I think this is not the case. Besides there is also the 240(l) who'll take care of the latter case.

Wow, I am so sorry. This is just tragic.. My condolences.

As for the GC, if she is already in the US and entered as IR-1, she already has her LPR status, nothing conditional about it. Whether it was legal at the time of entry to enter, knowing the petitioner died, I don't know. It may or may not cause a problem if she applies for citizenship down the line.
