Hello, I am new to this site as I just got married last week. I came into the country on an F-1 visa and ended my opt in January, so I am out of status. I met my husband in January and immidiately knew he was a keeper and decided to hang around and see how things go. It went well, I am married, tra la la la la :lol:

Anyway, since I am out of status we want to send in my application for AOS immidiately. My problem is that, we do not have any joint assets or documents. We are currently living in my house and I stay with family, so no rent, for now. Any advice on what we can send as evidence, other than marriage cert. will be greatly appreciated. Also, how do we go about building joint assets before the interview, will taking all new docs raise questions?. I stopped working in january and hubby also hasnt worked in a while (2010) but is actively searching.

Show photos, letters sent to both of you. Any joint bills, or at least individual bills sent to the same address? IN your case, affidavits from friends or community members (priest etc) that know both of you may help also.

Who will be your co-sponsor for the affidavit of support, or do you have enough assets (is the house in your name?) to self-sponsor?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks for the response. We just moved in together last month, so no bills or mails yet. The home belongs to family and I have been living there for free and will bonth continue to do so till we find jobs. My brother-in-law will act as co-sponsor. I read somewhere on this site that int'l students should file a form 8843, in place of taxes, this information is new to me and I never filed this last year. I didnt earn enough on the job I did for opt to qualify for filing taxes either. At least we have tons of pictures and can also get affidavits. Just want to send my application in ASAP, so that I can quickly get back in the thick of things. Regards

Being required to file taxes and being required to pay taxes are two different things, which people seem to often confuse to mean the same thing. F1 students are required to always file taxes in the US whether or not they make any income. If you didn't work at all, you were required to file the 8843 form – Statement for Exempt Individuals and Individuals with a Medical Condition. If you made income, you should have filed the 1040NR or 1040NR-EZ – Nonresident Alien Income Tax Return.

Oh my goodness! All these new information, I can't believe I have been walking in ignorance all along. No one at my school mentioned anything about F1 students filing exemption forms or any tax forms whatsoever, I am really vexed right now. Thank you so much for the enlightenment, i will visit the IRS website and read up on this issue. Thanks a lot!!!!!!!!!!!!! Can I still go ahead and send the application, while I work on filing the forms?

The forms will ask for your US Citizens tax return, not yours, as he/she will be the one to fill out the I-864 as your primary sponsor.

So, yes you can file your paperwork now.

July 2005 - met my awesome, hot, amazing love in Lousiana.

Feb. 2012 - Sent paperwork to Chicago.

May 2012 - Received green card.
