I-130 for Spouse upgraded

Hi guys,

I have few questions about the I130 application I filed for my wife. Let me explain the scenario first. I filed I130 based on my PR in March 2011. Last month I became US citizen and upgraded the application and got following email on May 7th. I didn't get any mail (just email) or was not asked to send my citizenship certificate.

"Thank you for informing our office that you have now become a U.S. citizen. Congratulations on your citizenship. Your previously filed Petition for Alien Relative (Form I-130) has been amended to reflect your new status.".

My application is at Vermont Service Center. How long will it take to process the application from now? Any estimated time? Also, does any of my time before upgrading the application count or anyway helps in expediting it? When can I expect NOA2?

Please help. Thanks in advance.

you must send a copy of your naturalization certificate to USCIS don't wait to email you or mail to send your naturalization....you can send it via email or mail but i suggest to do both.....and also you include your NOA1...

you must send a copy of your naturalization certificate to USCIS don't wait to email you or mail to send your naturalization....you can send it via email or mail but i suggest to do both.....and also you include your NOA1...

You DON'T have to send a copy of your naturalization certificate to USCIS.Email from USCIS clearly stated that your case ( I -130 Petition) is upgraded from LPR to USC. But if you want to send the copy of your naturalization Certificate for peace of mind, it should be mail to Vermont Service Center. Make a cover letter and put the details : petitioner's name, Beneficiary’s name, DOB for both and definitely RECEIEPT NUMBER. Also write down receiept number on the top of your copy of your naturalization Certificate.

But When you get your NOA2 ( Notice of your I -130 approved), you MUST send a copy of your naturalization Certificate and a copy of NOA to National Visa Center.

You never have to send the naturalization certificate at any time. The Alien number is the same as your citizenship number. I have gone through the same steps from Uscis upgrading the petition and fwding everything to nvc and i have an interview date next month.

I would however call USCIS and ask for an expidited processing cause u filed last year in march. They will respond as they did with mine and have ur case bumped up in the line for faster processing.

I wish you are right and the process is so EASY....Unfortunately, its not. I agree that USCIS is doing their best to make the process more practical...thats why they dont hold your case to upgrade ( LPR to USC), they change the code on the system that applies for USC ( CR1 vs F2A).

think twice, if you dont send your proof being citizen during any point of process, how they will approve the visa as CR1...I hope by this time you know what is the GOVERNMENT way...they want your documents in front and in their way...I cant figure out why NVC wants Certified documents on IV package instead of copy of documents and check the original during Interview...but thats not the case. there might be good reason ( dont want too much work load during Interview phase) and you have to do the way how NVC wants....Now If you are telling me YOu NEVER have to send the document that changes the whole I-130 petiton process, I cant buy it...

Certificate of Naturalization is THE DOCUMENT in the I -130 process when you upgrade the petition....

Good luck for the interview...but just pray that your case dont get dealy due to unsufficent document and you get a really soft and nice CO who accepts your document during the Interview

Couple of weeks ago there was one post where applicant went for the Interview and she/he had the document what CO was asking for but you know what CO did....CO wanted the document from the Petitionor via NVC ( something like that...Sorry I could not remember the exact situation but the CASE was DELAYED, applicant did not get VISA on hand)

As mudasirk said, Call USCIS just to remind them that its been more than a year( kinda sneaky) and your case it upgraded to CR1...Depend on who you talk on phone, they might answer your that PD counts from the date when you upgrade the case...Bad for us, there is no official document ( at least i did not find) that specifically talks about the PD what will happen when you upgrade your case when you are at USCIS...but it seems ( practically) they count your initial PD when you filled your Petition....If your case is straight forward, i believe you will hear from USCIC for NOA2 within next 2-3 weeks

Thanks navchusu11. I will call USCIS in the morning and check regarding sending the citizenship certificate. I checked with USCIS few times and they said since you got the email saying that your application has been amended to update the new status you don't need to send anything but I will check again when I call in the morning.

You r welcomed....

Call USCIS, not to ask whether you have to send a copy of Naturalization or not but for differnt purpose.

As i said, they already changed the code on their system and your I -130 petition is officially upgraded to USC. Now, its time to follow up whether USICS is treating your case filed as USC or not.

So, Call and ask them for SERVICE REQUEST considering your case is OUT OF PROCESING TIME FRAME ( More than 5 months). Some time you might not able to put service request because they might tell you that your PD counts from the date when you upgraded your petition. If you get such answer, keep calling until you will able to put SERVICE REQUEST. Sneaky part: you dont ask them whether you are eligible for SERVICE REQUEST or not, tell them you want to put SERVICE REQUEST.

As it seems ( at least I did not find), there is no straight forward writen rule regarding PD if you upgrade your Petition during USCIS, it can go either way , PD from initial date of filling or after upgrade, try your best to make it on your side. Telling you, you will definitely find one customer service representative who will take your service request....Within 2 weeks ( Probably 12/13th day) you will hear something, probably genetic email saying you will hear within next 60days, from USCIS...but good thing you make them to check your case and at least they will move your case from LPR to USC desk/drawer.....

When i upgraded my case, I had to work really hard..lot of Controversial emails...but at the end of the day, they count my PD as the date when I filled my Case.

So, If you keep in touch with USCIS in a smart way,you will get your NOA2 very soon...may be within a month.....

Your case is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter.

thats really really good news....they are working on your case BIG time...in general, they even dont send the same genetic email for 10-14 days.....

think positive.....they might give you your CASE NUMBER within less than normal process time at NVC stage....

I have started to prepare the documents for next steps. Is it better to send Choice of agent by email or by mail?

No doubt, email is the best option for choice of agent. DS-3032 ( choice of Agent) is completed by beneficary and if you want to mail the form then beneficary has to sign and you have to wait until you ( or NVC) got it .

Use the DS-3032 template for the email which should be ACCEPTED within 7-10 days after you send the email.
