No, I did not make these documents "only because immigration asked me to". I am glad we have now made them, and wish we had done it before, as we discussed it several times. We have been very disorganized with paperwork.

Please don't continue to imply that I am creating documents merely for the purposes of satisfying USCIS. That is not the whole story. I am very grateful for your help and advice, but would appreciate a little more sensitivity if possible.

Yes you did get them because you were RFE'd. You said you were "going" to get them but anyone can say that. Truth is you waited till you got RFE'd. Doesn't mean you weren't going to, but now it was done because USCIS issued you an RFE, or you'd have done it before filing ROC.. knowing what they ask and that they actually suggest these things in the I-751 instructions. Again, this does not mean your relationship is "fake". It does not mean that I am implying that, but the simple truth is USCIS will see that you did all these things after the RFE and it does become "manufactured" evidence.

I don't understand why you're getting so offended honestly and there's no "more sensitivity" that I should be giving, this is about your life here in the US continuing on its merry way, I'm not going to say pretty things because it makes you feel better, I'm telling you how it looks and what I think you should do about it. I'm not saying your relationship is fake, I'm simply stating (not implying, actually stating) exactly what YOU said in your OP which is that you got these things after getting RFE'd (OP modified for easier reading).

I filed in August 2011 and last week received RFE.

1. We didn't send utility bills because we had never bothered to change them from my husband's sole name when we married (he's retired, and I don't work.

2. We didn't send joint mortgage as no reason to change from husband's sole name into joint names, and mortgage would soon be paid off anyway.

3. We didn't send joint car insurance stuff etc because I don't drive.

4. We have no debts, liabilities, credit cards, loans or anything like that. We haven't been on vacation (hey, we live in Maine - why would we want to?!).

Since receiving the RFE (which was very scary and upsetting, as some of you know), we have very recently collected the following:

- New deed to the house in both our names - You said at #1 that it's almost paid off so there was "no reason" to change it.. So you DID do it only to please USCIS...

- Durable Powers of Attorney for us both in favor of the other - Great. But you've been married 2 years and ONLY did it after you got an RFE.

- Healthcare Powers of Attorney for us both in favor of the other- Great. But you've been married 2 years and ONLY did it after you got an RFE.

- Wills each in favor of the other - Great. But you've been married 2 years and ONLY did it after you got an RFE.

- Tax transcripts for 2008,2009,2010 - Should have been included in the beginning so great

- Copies of checks written by both of us for household stuff and utilities from our joint checking acount from 2009 to 2012 - Joint checking account is great. Esp if you've both been signing and it's not "new" because you've had it for a while

- Complete set of bank statements from joint checking, and from joint savings. - Great. Not "new" evidence, simply copies of stuff you had which is what they want.

My question is: how will they view the very recent creation of the Powers of Attorney, Wills, and Deed? Will the fact that they are so recent count against us?

To answer your question they will most likely ignore the recent info but it won't count AGAINST you (hopefully). So include it and see what happens. Or don't include it and instead rely on evidence that you didn't create after receiving an RFE. Up to you.

If you didn't include bank accounts, and tax transcripts in the initial one I'm willing to bet that's the main reason for the RFE. I have no doubt that sending the last 3 things alone will get you approved. I would send more photos, I would NOT send 22 affidavits (total overkill, maybe pick the best 5), i would send photos with friends and family... stuff like that. Again, I have no doubt you will be fine without the wills, POAs and deed.

**Edit - I will add another reason we haven't done new Wills or POA's here is my husband thinks its morbid and though I totally disagree he's being stubborn!.. so at least you got yours done. The deed to the house we purchased after marriage is only in my husbands name, but I am on the paperwork as his wife. I'm not concerned about any of these things... we'll do them when we do them.
