Hello all,

My Japanese fiance and I will be doing a civil ceremony with the county clerk next week. Her I-94 expires July 4th. I am going through all the forms we need to fill out and I'm confused because according to this timeline: http://www.visajourney.com/content/k1k3aos & http://www.visajourney.com/content/k1flow The AOS forms require two forms we basically filled out to get the K-1 VISA in the first place. But the AOS forms are named different. Also, I am confused about what specifically we need to do regarding the I-693 form. I am finding contradicting information.

G-325A Bio Info vs DS-156/K & DS-230: Its pretty much the same info right?

I-864 vs I-134 Affidavit of Support: I already filled out an affidavit for the K-1. Do I just fill the new one out with the same info?

I-693.

My fiance had all her shots, chest x-ray n junk, medical exam taken care of in Japan. Back in Nov 2011. She has her chest X-ray here in the apartment with us along with her medical exam forms. She has DS-2054/3025/3026/3030 completed. We will file for AOS within one year of her medical check. Does she still need to fill out I-693 and have it signed by a surgeon? What's the point of doing that?

As I tend to freak out when it comes to government paperwork and get confused about EVERYTHING involved, could someone let me know what extra things need to be submitted with the AOS forms. What else besides the actual forms themselves? ie, tax returns, bank statements, pictures, evidence, receipts etc

Yes, you will give forms with the same information. Get used to it.

Yes, you had to fill out a G-325A for each of you when filing the petition, and your wife will need to supply a newly filled out G-325A for AOS.

The I-864 and I-134 are not the same, and yes, you need to provide an I-864 and the financial documents that go with it as the USC spouse and primary sponsor for your wife.

If she had all the required vaccinations for AOS at the time of her medical and her DS-3025 has them marked off as being done, then she just needs to include a copy of her DS-3025 with her AOS paperwork and skip the civil surgeon and I-693. http://www.visajourney.com/forums/topic/335754-ds-3025-complete-or-not/page__p__4971318#entry4971318

AOS is a new phase and requires its own set of forms. Follow the VJ Guide and you will be in good shape.

Thanks for all your help everyone. I went through all the forms and filled them out to the best of my abilities. Any questions I had were answered by the EXAMPLE FORMS on the website. I do have a couple questions though. I was also able to collect all my tax forms and make copies as well as all that other junk. What I need now are just Passport Photos and Marriage certificates.

My questions are about G-325A & I-131

For G-325A

1. For all the example forms, the female character is giving her married name but at the bottom of this form she uses her Maiden name under FAMILY NAME.

Is there a reason for this? Or is it just a typo?

2. My fiance is Japanese and I expect her to write her name in Kanji in the non-Roman alphabet spacing. Since she will take my last name, I imagine she needs to add my last name too?

1. Under Part 3, questions 1 & 2 ask for intended departure date and length of trip. Thing is, we don't have any plans currently to go anywhere out of the country. But who knows what emergencies her family might go through during the AOS process. We would like to get the Advance Parole for security. And being in Detroit we may want to go to Canada or something. Any thoughts on what to do? If you apply, will you automatically be granted Advanced Parole?

2. Under Part 7, they request an essay outlining your reasons for needing an APD. If you have no specific plans, what do you put? I don't really want to lie. But we'd like the flexibility.

Any thoughts? Thanks in advance everyone.

Wish I had come across this site for the K-1 VISA process, I wouldn't have wasted money on a lawyer who made a mistake.

Is there a reason for this? Or is it just a typo?

I would think it is a typo/oversight and you would want to put the last name she is legally going by from now on, her married name, same as from the first box on the form. Someone can correct me if I am wrong.

She should write it out as the name she is legally using now, her married name, and sign the form in her married name as well.

Really? I have read all the directions and instructions and I can't find that. I'm not saying I don't believe you as I could have missed it. But is that really accurate?

Is there ever a situation where they would not grant an APD for a K-1 VISA holding AOS applicant? Are we guaranteed one just by applying properly with everything else?

Yes it's accurate that you don't attach anything (the form actually says to attach the AOS NOA1 - as you're filing concurrently you don't have NOA1 yet so you just file it together). This is what I did and of course I had no problem. No they wouldn't deny it as long as you apply "properly".

Yes letter C trumps B. It says "OR" at the end of B. You are filing it all together, so a "receipt" of having filed I-485 will be in the package.

Yes. Letter C is what I'm referring to and you will see it's "A and B or C" meaning you need either A and B OR A and C. A is the K1, B would be the written explanation, and C would be your AOS receipt. So you will be sending a copy of your K1 visa, and filing the AP together with AOS which takes care of C. If you filed for AP after filing AOS you would send a copy of your NOA1 receipt.

One last question about the G-325A form.

At the bottom it says:

"This form is submitted in connection with an application for:

--Naturalization

--Status as a Permanent Resident

--Other (Specify):"

What do AOS applicants via K-1 VISA route use?

Status as a Perm Resident or Other (Specify): I-485 ?? Are those the same thing or not?
