I came in to the US from Canada 2 years ago on a K1 Visa.

I took my husbands name on the marriage certificate and filed for my permanent residency using married name.

My 2 yr green card expires in Dec 2012

My social and drivers license are also both in married name.

Still married, but would like to revert to my maiden name.

What's the best way to go about this? What do I change first? Do I need to wait until my green card renewal comes up or would the name change need to happen before?

Name changes are done through the courts, not USCIS. Check with your local clerk of courts office for the steps to take.

Name changes are done through the courts, not USCIS. Check with your local clerk of courts office for the steps to take.

Thanks! Once it's changed, do you know if it's possible to change it on the green card at any time? And what would the procedure be?

You can either:

1. try and get your legal name change done before ROC and then just put the new name on the card; or

2. if you're too late for ROC and you're applying for USC then change it then; or

3. or if you don't want to wait that long, or if you aren't applying for USC, then file an I-90 and pay the $450 fee

Ah. OK. I've got another year before I can apply for USC.

Yes, RoC (Removal of Conditions) is when you need to renew your conditional green card which is only valid for two years. When you remove conditions, you receive your 10 year green card. You should submit your paperwork within the 90 day window prior to your card's expiration date.

You need to legally change your name back and show proof. When you got married, the marriage certificate was the proof. If you get divorced, you can probably use the divorce certificate. I don't believe you can just flip flop between names. You should do some research into how it works in your state.

You need to legally change your name back and show proof. When you got married, the marriage certificate was the proof. If you get divorced, you can probably use the divorce certificate. I don't believe you can just flip flop between names. You should do some research into how it works in your state.

If I start the legal name change process now I should have it in time to submit with my ROC application in September.

Before I have my lawyer start the name change process I'm just trying to find out whether it would raise any red flags and jeopardize my status. I'm not divorced. In a legit relationship. Just want my own name back :) But it wouldn't be worth it if it's going to get me thrown out of the country!

No it's not a red flag. It might make them ask questions but I doubt it.
