My wife and 18 months old son going to have immigrant visa interview next month. I am permanent resident.

Here is my little story:

My wife applied for non-immigrant tourist visa 2.5 years ago. She told CO that she's going attend her sister's wedding and totally lied about my information. Bangladeshi lady who was CO and took her interview. She was mad at my wife and told her that not to come to US embassy. Gave her piece of paper where said that my wife is recommended to apply for immigrant visa. Which i believe it was standard refused letter from US Embassy.

I am worry about my wife's interview in July. I also believe that bangali CO had put red flag on her finger/name.

Has anyone faced similar problem? and does my wife will banned to come US? what will be possible punishment besides AP?

If she lied on an immigration application there can be a lifetime ban for her.

If she lied about being married to you then she can have a lifetime ban

Sounds like you need to get a lawyer.

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

If she lied on an immigration application there can be a lifetime ban for her.

If she lied about being married to you then she can have a lifetime ban

Sounds like you need to get a lawyer.

I wasn't file for her immigration at that time She lied about my stayed in Bangladesh. She said i stayed bangladesh which i wasn't.

Someone told me that denied non-immigrant visa application has nothing to do with immigrant visa interview, since its been more than 2 years. Her database was expired because finger data only stayed 15 months.

I am not sure if there is any clear answer/solution to your situation.

Yes, it is said and pretty much established that B1/B2 and Immigration are two different stream, but in this age and time, when these information are stored in computer, how long do you think it may take someone to pull information? Then again, two separate process and they may not look for information from other stream.

This is a chance/risk you have to take and live with the consequences. I don't think this would be that big of a problem; however, my thought has nothing to do with your situation and what will happen. All depends on the interview, how she answers to their questions. Usually females don't get into AP as frequently as males, as for the males it's pretty mandatory. I wouldn't suggest you to be concerned with the AP, rather be concerned with the "Ban" part. However, don't get killed with foolish curiosity. Try to find as much on the internet on issues like this; make sure you ask your wife to get prepared for her upcoming interview, and (my 2 cents) if she's asked about her past interview and gets questioned about it, she should be as honest stating what happened with an apologetic demeanor. We all make mistakes (unless it’s repeated and gross) and I think if they find out that she’s sorry for the mistakes, it could be taken differently.

However as suggested, talk to lawyers and do as much research as you can before taking a course of action

What i am going to is write an explanation of letter. if she will ask for her past interview then simply she will submit the letter to CO.

I have talk to many Bangladeshi, all of them said its a common mistake and embassy look for only fraudulent immigrant. We have been married for more than four years, and have a kid. My wife should be in safe zone.

I will leave everything on God..

Mine situation is also little bit same.

As after my marriage i went to us embassy with my parents to apply visitor visa. N in the interview i did'nt told them that i was married.

I went at embassy with my parents and told them we want to attend our cusion marriage n even i dont have any of my cusion over there. I simply told lie to them.

The lady was very gud with us but she rejected us! N said no ...

After this my husband started all this process. We told all this story to our lawyer. And our lawyer said it's ok it does'nt create any big issue coz ever one wants to go US so many people applied to visit visas or any other. My lawyer told me if any one ask u abt this during my interview so i tell them true!

I think u should also do this.

I hope it won't effect on our cases...

As you said two different stream...My wife got approved.

Here's the interview details:

My wife and 22 months old son reached at Dhaka Embassy at 6:30 am, Wife seen a long que. since my wife has child, security guard let her in first. After waited for 45 min, my wife called in Window #1, which bangali lady took her passport, photos,questionnaire and most important IRS ACCOUNT TRANSCRIPT. Bangali lady asked her to sit and wait for finger print call. She waited around 20 minutes and called on window#4 for finger print. An Chinese lady took her finger print and told my wife to wait on final interview. after 15 minutes later she called on window#9 and an American white lady took her interview.

CO: what's your Husband name and date of birth?

wife: answer my name and date of birth.

CO: How's your husband went to America?

Wife: Student Visa.

CO: How he gained his GREEN CARD?

wife: Through H1B.

CO: Raised your hands and take : took the oath.

CO: Congratulations and you're approved, please come tomorrow at 2:30pm, your passport will be ready on Window#1.
