Advice urgently needed

Good day dear VJ family, i am new to this site and need advice urgently.

My fiance and i met several years ago before he left for the states but started dating last yr June (June 2011). We got engaged during his visit to Nigeria in December 2011..he stayed for 5 weeks. He wants to start filing now and got talking with an immigration lawyer. The lawyer adviced him to chill for another year before filing, so that the relationship will be like 2yrs old..it means hm filing next year June. Pls peeps, we are confused as we dont want to make any mistake. Is it really necessary to wait another year before filing? Your advice is needed and appreciated. Thank you.

It is not necessary to wait any amount of time. The only requirement in terms of meeting/ dating is that you have met once in the last 2 years (for the K-1 visa which I can only assume you are talking about).

It may make for a more compelling case to have a longer relationship, but it is NOT required.

No not required. But the reasoning I am sure he says to “chill”is because this is Nigeria. The high fraud in fact they say Nigerian Embassy acategory all its own.

First to look at your case you need to ask do you have redflags.

1. Big age difference where the woman is older.

2. Married before and you have children

3. Meet or dated soon after divorce or beforedivorce was final

4. Filed close after meeting

These are fraud indicators they look for and that’s why manyput a little space. But it’s not necessary as long as you submit or as we say “front-load”compelling strong evidence of your relationship.

And remember while your petition goes through all thosesteps up to interview you are still logging time in relationship maybe evenanother visit so that can be shown at interview (if you get a chance to showit).

It’s all up to you whether to wait another year. You alreadymeet the requirement to meet within 2 years of filing petition. And frankly youreally don’t need to waste money on a lawyer unless you have a difficult casethat needs legal advice. But know this a lawyer can’t make your case getapproved faster. A lawyer cannot guarantee any Visa. What they can do for you,you can do for yourselves and probably even better. (just saying)

**What I suggest is you and your hunni read through theNigerian Embassy Interview Reviews. And get a feel what’s up and asked and allthat.**

It gr8 though to know waiting another yr isnt a requirement. Fortunately there are no red flags per se. He's older, none of us have been married before...Nonetheless, we'll read through the Nigerian Embassy Interview reviews and other relevant sites to know whats asked and whats up and think it thru. Well good. I love people ready to take it on and show there stuff. Trust me read the guides and even some post especially in the African: Sub-Saharan forum that's where region specific information is.

Don't be afraid to ask (post) a question. We have all been there and if you thought it a bunch of others are too.

Just one thing some reviews may be sad or make you mad. Just use what they say as your guide what to do. We are here for you.

By the way, quite a few of us went through the process without a lawyer and wouldn't advise someone to use a lawyer, as we feel that the process is simple enough to do without one. I'd suggest having your fiance join this group and have a long read of it before he decides if you need one or not. If it's a simple cut and dry situation, then he may feel comfortable going without one, but if the case has other complications, then use your judgement.
