I have not filed a waiver yet, but i have pretty much compiled everything to do so. In our situation, we are pretty sure we are going to need one. My wife was in the US and overstayed her visa by 3-4 years. We just got our i-130 approved and hope within the next month to 2 months will have our consular appointment. At that time my lawyer has advised me that our K3 will most likely get denied and we will need to try for the waiver. Anyone know what the processing times are for this? Thanks

So your lawyer is not familiar with Marriage based petitions or waivers.

Actually my lawyer is very familiar. Just putting it out there to see if anyone has any first hand experiences. My lawyer cannot give me exacts as far as times frames go and was just curious. That website you suggested is pretty amazing though and has great information.

If he is taking you down the K3 route then no way can he be very familiar with current procedures.

I am so confused why the k3 route does not work. I have specifically asked him about this and he has reassured me that it is fine. In addition to that I just approved from uscis to file the k3. I am confused. Does it take longer that the ir-1? Does it not have a high approval rating? What is it?

Is there a particular reason you are trying for a K3?

That is what worries me about your Lawyer.
