Hi guys!

So yesterday we received our NVC Case Complete email, wooohoooo! Our interview is set for July 5th and we are getting things ready.

There's just one major doubt that I have and was wondering if you guys could help out. It'll also be a question we have for the embassy, probably asked in the next couple of days.

The visa is the CR-1 and if the interview goes well we'll be ready to move! However, due to lots of things and especially because we'll be taking our cats, we won't move until the fall. However, we have already made plans to travel to the States to celebrate my mom's birthday at the end of August. My sister is coming from Ireland and my brothers from Texas and Colorado, so it's something we can't miss. Also, we are going to combine it with traveling to some universities to check out graduate programs and hopefully talk with some people.

My doubt is the following:

If she has the visa in her passport and we travel at the end of August, but won't officially move until say November, should we do the official POE in August? Or should we explain that we are there for a week to celebrate the birthday and talk with universities and that we will do the official POE in November when we bring the cats? I understand that once she gets the ok and stamp at the POE she is free to travel abroad, but will it be a problem in the future if we aren't officially residing in the states during those two+ months? We won't make the time difference between August and the official move too long, but I would say after the holidays at the absolute very latest.

What do you guys think?

Why wouldn't you do the POE in August (providing you can)? Get it over with! They aren't going to be checking in on you during those 2-3 months between when you visit & when you officially move to your new place, and this would probably save you a lot of headache in advance :)

Pre-VISA

November 14, 2009 - met randomly in a park in Atlanta, talked 1 hour

November 16, 2009 - started emailing daily

December 11, 2009 - flew to DC for a weekend to visit

January 5, 2010 - JL flies back to Germany :(

March 17-23, 2010 - I visit JL in Germany

September 1, 2010 - I move to Germany!

September 9, 2011 - Married <3

German Visa

December 20, 2011 - applied for German visa

February 9, 2012 - interview

March 26, 2012 - temporary 18 month greencard!

US VISA

April 3, 2012 - mailed I-130s to Frankfurt

April 11, 2012 - NOA1 mailed

April 13, 2012 - I-130 payment authorized

April 18, 2012 - NOA1 received

Impatiently waiting for NOA2......

You don't actually have a choice. Once the CR1 visa is in the passport, she'll need to carry the sealed envelope with her for her next US entry. The entry will trigger production of the green card an social security card that will be sent to the address you indicated on the DS230. She's then free to come and go from the USA as she pleases as long as she's not away for too long. Waiting until fall to come back permanently is not an issue. The stamp on her visa serves as a temporary green card but somebody can mail the real one to her after it arrives.

Facts are cheap...knowing how to use them is precious...

Thanks a bunch guys!!!

That's pretty much what I was thinking and was just trying to play out all the scenarios with plenty of time beforehand and get some good advice.

Pushbrk- I was wondering about that too and what you say makes perfect sense.
