I 129 F previously filed

So I just found out today that my fiancée filed I 129f for us last oct but did not get approved cause of lack of the paperwork uscis sent him forms and asked him to resubmit and that's what he filed January of 2012. How is it gonna affect our petition now and why didn't they just requested for evidence instead of providing us with another case number and redo the whole application again? It's been so hard to be away for 8 months now. Any advice on what to do? What bout the previous case number we had why's gonna happen to that? *big big sigh

Confused! but. OK You had your NOA1 granted in October. You recieved a RFE soon after sent/replied in January. (There are time limits to respond to an RFE) or Cancelation of the Petition.

Your case never left the NVC. 1-603-334-0700. Did you ever get or see the Approval and Code? Was it ever even really Filed? It does happen. Your fiance can call and get the answer as to status. That simple. I smell a rat. The Petitioner would have been informed..

We are both confused too. When he filed that time he didn't know exactly why to do and filed it by himself. U dint exactly know what he sent but we were denied cause of the paper works and the biographical info form and intent to marry were all not submitted with the one filed in oct cause I don't remember filling up any. Then instead of the request for evidence they make him the form he sent which he had to attach to the form he sent January. And now they issued him another case number diff from the previous one. So we have two

Did they send you an NOA1 for your October application? Maybe you could check with the USCIS if that application is still active... It could be that they have already cancelled that first one and now you just have to follow-up the latest one. Thanks I checked it on the site it says it's on ACCEPTANCE stage and never moved from therein since October. A bit weird though that we have two case numbers. I'll just ask him to call to be sure, takes him 3 hours but it's the only way I guess. Thank you and God Bless

Your first petition is gone. There was not enough required material included. The second petition would require all the documents listed in i-129f instructions, including a waiver as to why this is second 129f petition within 2 years.

There is a limited time available to reply to a RFE, so I would assume if your partner did not reply that the first petition was canceled.

Either way, I believe you cannot have 2 active petitions.

There is a limited time available to reply to a RFE, so I would assume if your partner did not reply that the first petition was canceled.

They did not get an RFE their application was denied. They re-filed their application in January.

OP: The original petition was denied, the first case number is irrelevant. If there is too much information missing from your file then they will deny you and not issue you an RFE. Hopefully your partner read the instructions and gathered the correct documents before sending in the second petition?

Yep that's what he said he mentioned bout te waiver and all but then I asked him to contact USCIS to make sure everything will be ok. I'm curious though if it has ny effect on the 2nd petition we filed as to processing time and all.
