hello,

we are in the process of getting my UK husbands CR-1. we just got his police check back and he has a caution and a driving with excess alcohol on it from nearly 7 yrs ago. we are afraid this will hinder his application and don't know if we should proceed with the 864 and paying the $400. does anyone know what exactly will not get you the CR1 visa? what to do??????? :unsure:

2003 Sept03 met on a flight to Amsterdam

2004 Nov03 married! Cardiff, Wales

2005

May05 mailed I-130 to Texas Service Center

Dec05 I-130 approved

2007

May 09- case forwarded to London embassy

May 30- received interview date!!!!!!!

June 27-medical exam London

July 11- interview London: visa held, more paperwork required

July 13- courier p/u passport and paperwork

July 31- passport sent back- paperwork not acceptable

Aug 07- courier p/u passport and cosponsor paperwork

Aug 10- letter received, need co sponsor's proof of citizenship

Aug 14- sent in co sponsor's proof of citizenship

Aug 25- courier delivered passport/visa, nobody home!

Aug 29- passport w/ VISA successfully delivered!!!!!!!!!!!

Aug 31- robbie flies to omaha USA!!!!!!!!!!!!!!!!!!

Sept 25- received SS#

Oct 31- received Permanent Residents card

Why not contact the US Embassy for a definitive answer ?

hi ,saw your post and thought i would reply .i have heard that drink driving is now classed as a criminal conviction ,and what was the caution for ? if they are classed as crimes involving moral turpitude he will need a waiver. i had to do one for my k-3 in london back in 2003 ,it got approved ,but my aos state side was denied ,!! i am back here now in the uk ,going through it all again ! let me know anyway ,i would like to try and advise /reassure .thx ,andy. :thumbs:

you should be fine, you will need a waiver, get a good lawyer to prepare your waiver! Its been 7 years.....have to show that he is sober, and paid his dues!

his interview is this wednesday??? will they refuse him and tell him to do this waiver thing???

i just now have read your reply!

wow! so our interview is in 2 days and my husband is freaking out big time, especially since i am not there with him.

we are paranoid about his drink driving offense from 10 years ago hindering his visa outcome.

i've read we may need a waiver, but i don't know anything about it!! what is this waiver? does he need it for the interview? will he be told to do this waiver only if he is refused??

what are moral turpitude crimes?

omigosh, we are totally losing our minds...

what did you have to do your waiver for?

why were you refused AOS?

what is your story, sorry... i have so many questions!!!

we're desperate for answers,

Hi, justbee. I'm sorry for your situation - try to relax if you can because it should be okay in the end. You do not need to have done anything for the wavier yet. If your husband receives a denial (remember that this does not mean in any way that he will never receive a green card), then you will need to do the wavier. There is a folder here about waivers, and it should be quite helpful. For now, just focus on getting through the interview and taking things as they come.

EDIT - Also, you do not have to worry about AOS that andy is referring to. That's adjustment of status not affadivit of support. You're going through the process for an immigrant visa. If it's denied and then the wavier is approved, you won't have the same problems andy has run into.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
