Hi everyone! biggrin.gif

I am a naturalized USC and my mom will be here in a few days, She is on multiple entry visa and been visiting US for 3-4 x now, w/o overstaying. The last time she was here, her BF ( She's divorced, in case you are all wondering )from Florida proposed to her and they got engaged.Now my question is, Is it better if I will file my petition for her along with AOS since she's already here? or If they will marry while she's here , Can my soon to be step-dad petition her? Which way will result into less complications?helpsmilie.gif I also have 2 younger siblings back home one is turning 18 the other is 16, I know my mom can petition them once she gets her green card. Thank you in advance for all the response.blush.gif

03-11-2011: mailed AOS packet

03-14-2011: AOS packet received

04-16-11:USCIS lost our I485 forms thus received EAD rejection notice

04-18-11: mailed AOS packet AGAIN

04-19-11:AOS packet received by S. Bush

04-29-11: NOA1 hardcopies for I485 and I765 received :)

05-12-11:Successful walk in biometrics

05-25-11:email notification received stating interview on 6/24

05-27-11:hardcopy for interview received

06-24-11:done with interview.no approval yet

06-25-11: received EAD card

06-29-11:email received AOS approved and green card is on its way! yay! :)

If she doesn't want to rush marriage then she can AOS through you, if she does she can get married then AOS. However for both AOS it should be unplanned as otherwise is a violation of the I-194 your mother signed at the airport/the border.

Not sure but I think that if the marriage takes place b4 your sis/bro is 18 then your step father can petition for his step child and get he/she in the US in less than a year. Your other sibling would have to wait about 3-4 yrs before he can go to the US BUT only if your mother's AOS is done speedily and your sibling doesn't age out of the F2A category otherwise your sis/bro will have to wait about 8 yrs if he/she is moved to the F2B category or upgraded to F1 (8 yrs total) after your mother becomes a citizen. The wait times also hinge on if your sibling remains unmarried. Since both relatives are currently under 18 your mother may find it necessary to get married soon if she wants both her kids with her asap.
