I got a hold of him today and updated him on my situation, he immediately drew up the letter to withdraw my petition for AOS. He also is sending me tomorrow to a local Uscis office here that has a fraud unit.

withdrawing the petition is not something that is done - withdrawing the affadavit of support, though, negates the petition, automatically. It may take some time for the withdrawal of the affadavit of support, the I-864, to wind it's way through the system - that's why I told you to send 3 of them, to 3 different places.

If you hand carried the letter, gave it to a USCIS human, live, face to face, then they will do stuff on their computer, send a flag on the casefile. When/if the casefile is reviewed for 'green card production' - the clerk doing the eyeball review in the computer will see that flag, and not print the greencard.

Of course, if you knew the casefile #, you could look up status on the uscis website, to get some idea of what's what.

So he already has his green card? If so there is nothing you can do. You can no longer pull the affidavit of support once he has the card. I was in a sim,ilar situation and divorced my ex. She is in California and her card expires on November 2, 2012. I have been informed by many people that she will most likely get her conditions removed as filing a waiver based on a Marriage in Good Faith is not hard to prove. Some pictures, anything with your name jouintly on paperwork, pictures and affidavits from friends who can say they saw us as husband and wife. I did file evidence against her and had a wintess statement also. I just hope that leaving without marriage counseling or trying to work on saving the marriage and only having the green card for 7 months will carry some sort of weight. If not, I really don't care. I am happily engaged to Jovi and my ex did me a favor and got out of my life so someone who actually loves me and appreciates me could come into my life. It was hard the first month, especially when I obtained pictures of her in her American brother-in-laws best freinds arms romantically involved less than 3 weeks of leaving me and while we were still married. I am living proof that there is life after the betrayal and someone more deserving of your love is waiting for you. Now I will say this, as I know some people from West Africa and they say Nigeria is one of the most scamming countries in Africa. Maybe you should look else where. And for the Nigerians, I am not saying that all of you are scammers, but a lot of you are. This is based on other Africans not from Nigeria and of course the scams ran trying to get peoples money from their accounts using scam e-mails and also documented on CNN, etc... There are a lot of good, but also a lot of bad. So no offense is meant, so please don't take it that way. If you are upset then maybe you are in the scammer category.

For many reasons this might be the best thing for me due to some of the threats, but to be honest it really is driving me crazy. I am taking advise of others and attempting to put my emotions on hold and do what I have to do to protect myself right now.

So bottom line is, you are telling me that this man who clearly scammed me will stay in the United States with a Greencard in hand! Things I didnt mention in my original post because it was more personal then I had wanted to get were the physical and mental abuse he put me through. The comment he made to me stating he would never go back home and would rather spend like life in a US jail because he would kill me if I F**ked him over. Of course screwing him over is whatever he felt was a wrong doing on my part. So I guess I have to resign myself to the idea of looking over my shoulder, inability to sleep because I am now jumping at every noise I hear in my house because it doesn't matter; this man will get everything he wanted from day 1.

If he has the 2 year card she can't "drop the I-864". It's done and accepted. He should be fine to ROC by himself unless she has evidence of fraud

I was replying to the person who said he HAD his 2 year card and that she could pull the I-864 which is why I said "if he has..." Preventing him from getting the card in the first place is her first step.

And no, leaving as soon as he thought the paperwork was "set" isn't evidence of fraud. He could argue that she was abusing him and he needed to run away, he could argue that it was never about the card which is why he left. I'm not saying any of this is true simply that these are options for him, people commit fraud to get their cards all the time. Its not right and luckily she has the emails and other evidence.

I think she SHOULD pull the I-864 asap, report him to ICE as well as his emails and threats of harm if she stops his process, file for divorce with a restraining order based on the threats.

Watch out! Are you sure he has not found out you withdrew your support? That could be exactly why he is now claiming to love you and want to "work things out"!!
