So my fiancé was recently divorced and we are wanting to marry so that we can pursue me moving to the US to be with her. She's in Wisconsin which has a stupid 6 month waiting period for marriage again after divorce. Our idea was to get married somewhere else (Canada, Las Vegas, Chicago) where they do not have the same laws governing when you can re-marry. What are people's thoughts on whether or not USCIS would see this marriage as valid given that WI law would not show it as valid?

09/04/2008 - We met online

02/01/2011 - We became a couple

06/09/2011 - We met for the first time

06/21/2012 - We got engaged

10/26/12 - I-129F Sent

11/1/12 - NOA1

04/23/13 - NOA2

05/16/13 - Consulate Received Package

06/7/13 - Package 3 Sent

6/14/13 - Medical Interview

6/25/13 - Interview Scheduled - APPROVED

I don't see the need to rush anything especially marriage. Marriage is a long term thing not just for one day or to enter the US. You seem in a rush, is there a reason for this? I ask this because the process for filing takes a while it will not happen in 2 or 3 months so think of the real purpose and maybe it will tell you what immigration will think about your petition being valid or not. Thats just my view I don't have to be right.

As someone whose now wife used to live in Wisconsin and we got married in Wisconsin... I can say for a fact that you can't marry before the 6 months waiting period. Now a state like Minnesota which is bordering Wisconsin to the North doesn't require that. In MN which is where we live now, you can get married even in as little as two weeks after you file for divorce. I've seen it happen. So like someone said earlier, you might wanna do a google search on that just to get a much more clearer perspective or look up the county's courthouse #, call them to find out but the truth is you have to wait 6 months. No need to rush it else you'll be in a bind when questions arise about it as regards USCIS.

3/23/2012 (Day 1) - Delivered to USCIS.

3/27/2012 (Day 5) - E-Notification that paperwork received.

3/28/2012 (Day 6) - One check for $1,490 cashed & cleared for I-130 and I-485.

4/02/2012 (Day 11) - NOA hard copies received (x3), case status available online & bio appt. also received, dated 04/12 @ 8:00 AM.

4/10/2012 (Day 19) - Case status online says changed to RFE received.

4/12/2012 (Day 21) - Successful biometric done.

5/11/2012 (Day 50) - Complete RFE (I-864) received. Case status online changed to RFE received.

5/16/2012 (Day 55) - Online case status says: Card/ Document Production.

5/21/2012 (Day 60) - Online case status says: Card picked up by USPS.

5/24/2012 (Day 63) - EAD card in hand.

6/12/2012 (Day 82) - Testing and Interview.

7/12/2012 (Day 112) - Interview date!

7/12/2012 (Day 112) - Approved.
