Hi everybody! I went to the bank today to make some changes in our accounts and when the teller pulled out our information, I noticed that I was listed as a US citizen in their data base. I had the guy change my info immediately and I asked how in the world they have me as a us citizen as I have never claimed to be one. He says he doesnt know. What do you guys think? Should I worry? I'm planning to apply for my citizenship next year and right now I'm getting really paranoid!

While I understand that some would be worried, I would not make an issue of it.

The reason is that when you file your N-400 and sign it, you are putting information to the best of your knowledge, which mean this is what you are sure about.

Ppl everywhere make mistakes, and I wouldnt be worried about someone else mistake, yes it ca n cause you troubles but as long as tell the truth you r good. if USCIS find out that I was recorded somewhere as US and I denied that, it will be their race to prove it as long as I denied it.

In case of banks for example, they will require any forms you signed saying you are US citizen etc, if there in none, then there is no case......

So in short, fix it, and fill the N-400 with true and correct information known to u , their job is to make sure all information provided are correct and that you did not lie, if accused of lying, they need to prove it otherwise you can take them to court since no one can ensure all will do their job the right way.

I dont think that anyone can enforce something that is not true or without prove, even USCIS.

As long as you do not have signed a form claiming to be a US citizen, you should be fine. The bank obviously made a mistake. Did you open that account when you were a permanent resident?

No, I didnt open it when I was a resident. As far as I know I have never ever claimed to be a USC, i really had no reason to do it; but now I'm starting to think "what if I did and I just don't remember?" first time I ever opened an account I showed up with my passport !

This is what I am saying.

You don't own it if its not yours. the only time you are in trouble with this is if you calimed ur self as US in the N-400 or any other documents.

you are clean and this is perfect :)

But you know, it wont hurt to make some calls here and there to check and correct just for the sake of feeling better and making all your data up-to-date and accurate.

Thank you! I will try not to worry too much. I read about a case here who got denied because he claimed to be a USC on an online job application and I guess that scared me a bit. It really messes up your head! :)

Yes, if you willingly claim USC, register to vote, and vote while still in PR status, then you are in serious trouble.

Your case is different where the bank made a mistake. So you should be fine.

I would not worry about it. Most of the banks ask you if you were a "citizen/permanent resident". That is a standard question. If they ask you for more information then you would choose PR and possibly they want your country of citizenship. Most of the time the question would be stated as "Citizen/Permanent Resident". Dont worry too much. Unless you have explicitly claimed you are a citizen or if you have voted in an election pretending to be a citizen or served on a jury pretending to be a citizen then you are ok.

Before I could even add my wife to my checking account, and due to the American Patriot Act, needed at least an EAD card and a probationary social security number. Wouldn't even let me add her as a beneficiary in case of some reason, I would get killed. That is how strict our banks are, went to several others with the same story, even trying to open a 500 buck account for her. They wouldn't even to that, like 500 bucks would be enough for a terrorist to commit suicide.

When she finally received her conditional green card, we went back with a permanent SS number, but that was the last time. Each time they made an FBI check on her, but that only took a couple of minutes. Wonder why it takes the USCIS so long to do that? Same with me buying a gun, takes all but five minutes.

So wondering about your bank assuming you are a US citizen? Maybe you should report them to the APA. Instead of getting scared, you should get angry. Oh, once she got her conditional green card, we never went back, no reason to.
