If the father is a born US citizen or meets the requirements you have to file CRBA and get a US passport.

A USC child cannot enter the USA on a visa and is not eligible to get a visa. They must enter the USA on a US passport.

Your husband needs to Report the birth to the US consulate, for your kid is an American. See below for FS-240 Consular report of birth abroad.

No my husband is nt a born citizen...

Check CRBA requirements, if you meet all the requirements than you have to report the birth to consulate and file the application for CRBA.

Based on that the child will get a US passport and he would be US citizen.

I could be wrong but born citizen is not the requirement, I believe the requirement is one of the parent has to be USC.

Which is why i also said if he meets the requirements. Because either way you still have to research and find out about this.

Birth Abroad to One Citizen and One Alien Parent in Wedlock

A child born abroad to one U.S. citizen parent and one alien parent acquires U.S. citizenship at birth under Section 301(g) of the INA provided the U.S. citizen parent was physically present in the United States or one of its outlying possessions for the time period required by the law applicable at the time of the child's birth. (For birth on or after November 14, 1986, a period of five years physical presence, two after the age of fourteen, is required.

The requirements:

If you are born abroad to one United States citizen and one foreign citizen, you may be considered a U.S. citizen if you meet the following requirements:

•One of your parents was a U.S. citizen when you were born.

•The parent who is a U.S. citizen has lived at least five years in the U.S. before you were born.

•The parent who is a U.S. citizen must have lived in the U.S. for at least two years of these five years after his/her fourteenth birthday.

If your USC husband meets the "presence" requirement above then your child is a US citizen at birth.

But it doesnt matter as one the child enters the US, he will be a naturalized citizen

Unbelievable that my journey took this long but Im thankful

i m in the same boat....is they count five years residency after i got USC or from the green card residency period.i am naturalised citizen in nov 11....but my baby is going to born on feb 2013.my wife is permanent residency....but lives in abroad
