I am Moroccan, aged 35 years, my wife is USC. 39, married three months ago n morocco, agadir city :), and owe plans to begin the process for a CR1 visa, i wanna ask about her us tax return....

the I-864 is the Affidavit of Support form that requires copies of the petitioners past 3 U.S tax returns, my wif ll fill this form , her 3 tax return :

for 2011, nothing, 2010 a little over $7000, then 2009, like around $33000

she s working as a nurse now,

that ll be a problems if she couldn t work or has no us tax returns,for one or two year

wait for ur reply and advice thannnnks

If she is working as a nurse now and you are just now beginning the process you will be ok. By the time your case gets to the point of needing to send in the tax information she will have many months working and they will also consider her current income in regards to the affidavit of support she will submit. She has to earn a certain level of income depending on her number of dependants. Have her look at this link to figure out where her income needs to be at. 2012 poverty guidelines

The rule is that the petitioner must earn at least 125% of the national poverty income rate, according to number in the household (including the applicant), in order to qualify to fill out the affidavit of support. Although her current income will be considered, the fact that she claimed $0 income in 2011 and well below the poverty line in 2010 means that she is currently unable to prove that her ability to earn the minimum income is stable. Since she can't prove that she's got financial stability in her life, you'll need a co-sponsor. After all, the whole reason to have an affidavit of support is to show that you have access to financial resources that will keep you from becoming a financial burden on the US government. Although she has a job now, nothing is guaranteed (especially in this economy), and her history doesn't exactly fill one with confidence that she'll have you covered if her current job doesn't last. Sorry if I sound harsh, just trying to explain the reality of the situation... hopefully it'll save you the trouble of having to take extra steps on the back end that cause you to wait longer.

i suggest you dig out a calendar and try to forecast when and where in the process the I-864 will be first 'accepted'.

When you study that, you should see that it'll be sometime in 2013, and (IMO) she'll have a good year of income as a nurse (in 2012) plus the current annual income in 2013 to overcome her prior 'lack of income'.

So, study a bit, then make yer own calendar, and let us know what your thoughts are?

Baloney. If she's working now and continues to work until the affidavit is required, she'll have no problem at all. She's not demonstrating a stable past income, just he ability to have a stable income going forward. As a nurse, that's not a problem.
