I m out of my status for a month , is it wise to fill I-131?

A properly filed I-485 application to adjust your status stops the accrual of unlawful presence. See example 1 on page 9 of this USCIS Memo: http://www.uscis.gov/USCIS/Laws/Memoranda/Static_Files_Memoranda/2009/revision_redesign_AFM.PDF

As long as you have not accrued 180 days of unlawful presence, you may travel out of the U.S. with advance parole. Bring proof that your unlawful presence did not exceed 180 days for border officers to review. This includes: (1) the duration of your initial stay (such as a copy of your expired I-94), and (2) the date you applied for adjustment of status (a copy of your NOA1). USCIS should have this information in their records, so this evidence is to avoid all doubt.

Although the USCIS Memo indicates that aliens who do not have lawful status in the U.S. are subject to removal, USCIS defers the initiation of removal proceedings for adjustment applicants until the I-485 is adjudicated. If you are at any risk of being detained by immigration enforcement, carry a copy of your NOA1 to demonstrate that you have applied to adjust your status.
