thank your milimelo for this i have given this information to her this morning. although she seems to think she cannot do any of this becuase the lawyer said she couldnt

The lawyer is wrong. Withdrawing the I-864, affadavit of support, will 'kill' the casefile, as the affadavit of support is required for a petition and application (I-130,I-485)

so..

I smell collusion here.. on the part of the attorney. Either that, or he is expecting more monies for something, and if you kill the case via I-864 withdrawal, his 'billables' disappear also.

Simply draft up the letter, she signs it, and then send 3 sets out:

1. local USCIS office to where the interview is to be held

2. NATIONAL USCIS Office

3. local ICE office.

all of these addresses are easily found, btw..

AFter 4 years of marriage, can't he AOS on his own or smth?

usually not. there are a few loopholes, i'm betting the attorney has already prepped the 'husband' about them.

Your friend is in a dangerous place. She is in the midst of people wanting green cards at all costs. Have her contact the local womans shelter for help. Even if the house and its contents are hers they can be replaced and her life can't ( don't forget he could try to continue the petition as a widower ) She needs to file for divorce ( AOS ids for a married couple not people divorcing ) Take the divorce papers to an INFOPASS appointment and withdrawl the I 864 and then serve hubby with an order of protection/restraining order. It may be safer for her to leave the house than to try to stay there. Many police will do a peace keeping effort if someone is moving out from such a situation. And report his layer to the bar association.

I think this is great advice. The attorney is full of BS, the husband is full of BS, and his family is full of BS. It sounds like they'll do about anything, and she needs to make a move now to get this resolved. I know she's scared, but the longer she waits, the more difficult things will get and the more difficult time she's going to have making folks believe she was misled the whole time.

2012-08-01 (Day 83): Update Text Received; EAD Mailed

2012-08-03 (Day 85): EAD In Hand!

2012-09-19 (Day 132): Update Text Received; Interview Scheduled for October 22, 2012.

2012-10-22 (Day 165): Approved on the Spot!

2012-10-25 (Day 168): Update Text Received; Green Card Production Ordered

2012-10-29 (Day 172): Green Card In Hand!

2019-12-18: Sworn in as United States Citizen!
