All,

My wife and I just went to the RMV to get her a STATE ID. The officer was not able to issue the ID because of the following reasons - EXPIRED I-94 on her Foreign Passport. Let me explain the sequence of events.

1. She arrived to USA under a fiancee visa (which expires after 90 days) 2. We got married - this OVERRIDES the EXPIRATION of the fiancee visa status time limitation (per Department of Homeland Security) 3. Current filing for adjustment of status (Green card) and case pending.

She has a valid Social Security #, valid Bank Statement (showing proof of residence), marriage certificate and a valid current Foreign passport (with expired I-94 - which is obsolete anyways.)

What do you suggest? I've even written to the department of motor vehicles and explain the situation and they replied "she has to wait for her status change ie when her g.card gets approved).. Arghhhh !!

I was planning to get one too but I think I need to wait til I submitted my application for the green card. Once I received a notice of action in which if you look on the requirements again for the legal presence of an alien is that that one will do.

here in iowa, DL and state ID are already centralized so i think the requirements that they gonna ask are the same as in other state.

I tried applying before my I-94 expires (we are already married, AOS pending and no ead yet) but i wasn't granted. They are looking for a valid ID issued by the US.

When I had my EAD and AP combo card, they accepted it so i was able to apply.

They will also ask for a proof of residency. I just shown our marriage certificate stamped envelope that I received in january, with my name and address on it.

I am the OP again.

I read again the guidelines for getting the ID. It could be there is a way around this..For all intent n purposes, I don't want to break the law but having no ID is just a PITA and risky to carry a passport around while traveling in continental US.

MA requires 3 different paper to get ID and let's say I pick

1. SS to prove signature

2. Bank statement to prove residence

3. Marriage Certificate to prove date of birth

Nope. You obviously didn't read the requirements. Here: http://www.mass.gov/rmv/license/ID%20chart_front.pdf (emphasis added)

You must provide one document from each list below to prove Massachusetts residence, signature, and date of birth. These must be three different documents.

In addition, you must provide a verifiable SSN or a Denial Notice (not more than 60 days old) issued by the SSA with a visa, I-94, and current non-US Passport

Her SSN says she's an immigrant (on the system), her visa is invalid now and her I-94 is expired.

You must wait for EAD, like everyone else has been forced to.

Yes - I misquoted. We married within 90 days .. That's what I meant to say.

I already got the I 797 Notice of Action for the I-485 application. Is there a website to say this is a valid document pending final adjustment of status. I am in Massachusetts.

I have a feeling that IF I went to the DMV before the I-94 expiration date, it would'nt have been an issue???

In Nebraska, we had to get the state ID before the i-94 expired.

In Arizona ,we got DL by showing unexpired I-94 with foreign passport and foreign DL.

Took a written and driving test,same day.

Got a DL ,but with the same expiration date as the I-94. They said once we get GC ,we can come for a new DL that will expire on 65th birthday.

In ID I had to wait until my EAD came, and my green card came in the mail like a week later. If you need it for getting the marriage certificate usually you can get the certificate by throwing every ID she does have at the clerk and hope they'll take it.

Same in AZ, we pushed for a DL which expired in one week on the I94. Then the I797 arrived it extended it till its expiration date, the changed expiration date on the GC date. I797 should be good, i would double check that you need an EAD, what if you will not work then you don't need to drive? Nancy Nguyen should know if she is from there.

My wife and I live in MA.

We had trouble getting her an ID card when she first came.

I remember that they wanted a bank statement or letter addressed to her to our address. It took a while but we finally got her ID using the envelope for her SS card that was sent to our address. They did not seem to be interested in the green card that she had.

It seemed like like we used our marriage certificate, her passport, and the letter from the SS Administration addressed to her to our address.

I remember when I moved to MA from New Hampshire, I had to go through the same pain in the #### process for getting a MA drivers license. I had to use the utility bill that was addressed to me. An in order to get the utilities in my name, I had to either showe a lease or purchase and sales agreement for my home with the utility company. I guess a few of the illegals here have burned the utility company.

I do know that MA is an awful state to live in.

Illegals here are treated better than the legals and citizens here in the state of tax-a-chussetts.

But of coarse when you vote, you do not need to show any ID. Go figure!

Most likely she would have to wait, there is not an alternative. Lately most states have gone onto model where they would not issue ID or DL to ppl who do not have a legal status.

In your case your wife is waiting on the getting the status, once she has her status adjusted she would be able to get the ID or DL.

I am in the same boat as your wife and was told the same thing in NJ.Perhaps your State will be different. :thumbs:

Same for us in Texas. There was a lady that posted here (from Austin, Tx. mind you) that she took her NOA1 from the I485 and was able to get her lisence renewed. Have you tried that?
