Question about process?

Hi all,

I was reading through the general information about the N-400 process. I'm helping my husband fill out his application i petitioned for him 3 years ago (i'm a citizen) do we need to include proof that we're still together? it does not say anything about proof on the application or the instructions and i see a lot of people here are sending these kind of proof....Is this really necessary? Thanks!

Yes, you need to submit proof of "ongoing relationship" as husband and wife, if your husband is applying base on 3 years marriage. Examples are joint tax return, joint bank accounts, joint utility bills, credit cards, mortgage, etc. etc....

To apply based on the 3 years of marriage a person must prove that they meet the requirements.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Those are for ROCs, UNLESS USCIS asks for your N-400 application.

I'm still married and all I submitted with my N-400 package is the joint tax returns TRANSCRIPTS (which you can get from IRS for free) for the past 4 years, my GC, my wife's birth certificate, passport and our marriage certificate.

Like Anh Map said, just include the documents that proofs you are eligible for whichever category you are applying for.

Funny story is that my ROC IS STILL PENDING.

Nah this is WAY simpler than the freaking ROC. Refer to my list of the documents I sent, it's a LOT simpler.

Go to IRS' website and obtain free tax transcripts, you will receive them in about a week.

N-400 applicants based on marriage are presume to have their conditions removed by the time they apply. Problem is the N-400 department did not foreseen just how slow and ridiculous the I-751 department is. I'm in this boat as my ROC is been about a year now and still being pending.

I got my congressman involved now USCIS told him and me that they are just going to process my N-400 and ignore the ROC if it approves. Already got electronic notification I'm scheduled for interview so hopefully it'll end soon.

I'm tired of dealing with them.

Wow, you still haven't gotten a response!Unbelievable!I wonder what are they gonna tell you at the N-400 interview if you pass it and ROC is still pending? It makes sense to ignore the ROC decision if approved. Nonetheless, the question is, would they still approve N-400 if the ROC decision is unknown? I really hope things would clear up for you soon! :thumbs:

That's why I got my congressman involved. In response from the USCIS director to my congressman, she said that since I have a N-400 in progress, if the N-400 is approved then my ROC will be closed, otherwise ROC will remain open.

Heh, sometimes I wonder what USCIS is doing TBH.

Waiting on the interview letter, any day now.
