It seems like USCIS decided to pass over the remaining March, April, and May petitions. I hardly ever see any approvals with these NOA1 dates anymore. It's very discouraging. I think they forgot about us. We should just start all over and send in new petitions, I think it would be quicker. :D

I know what you mean. It makes no sense for them to spend time processing July and Aug. when they still have so many from March, April and May. We can't all be waiting for security checks. I know I'm not, my Congressional inquiry said it's just being reviewed. They just don't care to be fair.

We are nothing to them. Even though they wouldn't have a job if it wasn't for us. There's no incentive for them to do a good job, unlike if this was a business in the private sector. No competition.

Govt is too big!!

That has been the way they work... if they feel like... they can process two months of work within one month and if they don't... you won't expect to hear anything from them for couple months...

Because businesses in the private sector never ever ever screw up, just the government! In other news, I gots me some nice bridges to sell ya.

I'm beginning to wonder if it's time for an election-season concerted push from the CSC people. Local media, maybe?

If I read the guidelines correctly, if the USCIS has went beyond the 60 days as stated on the NOA1, you have grounds for an Expedite request. Granted all that will do is get you form one waiting line to the next one at NVC. We are at 30 days since our NOA2 approval and NVC still claims CSC has not sent the NOA2 ot them. With thier tracking system, I do not trust them. good luck, Payato

11 Oct 06 - Case MNL783xxx received by Manila Embassy... guess NVC lied

26 Dec 06 - Received Packet 4

18-19 Jan 07 - Medical complete early, scheduled 8 Feb

19 Jan - CFO completed after SLE shots... have to go back for the stamp after visa approval

15 Feb 07 - Interview Approved

24 Feb 07 - Arrive at Honolulu POE

2 Apr 07 - Married, civil ceremony, mailed AOS

17 Apr 07 - Checks cashed for AOS & AP

22 Apr 07 - Filed Expedite for AP

8 May 07 - Biometrics Appt

8 May 07 - Filed complaint with local USCIS for no action on Expedite request

9 May 07 - AP Expedite approved via email

14 May 07 - received AP I-512L documents in the mail

25 Jun 07 - AOS Interview scheduled but cancelled due to deployment and family emergency

29 Nov 07 - Visited local USCIS to reschedule AOS interview

15 Jan 08 - Local USCIS finally forwards reschedule request after formal complaint

28 Mar 08 - AOS Interview ..investigation reopened due to incorrect birthdate that was identified 05/07

16 Apr 08 - CRIS Notice of GC approval and welcome notice via email

25 Apr 08 - GC received finally!

19 Jan 10 - Package received at VT USCIS

I think what they are doing makes sense.

If you have a pile of mess filling up your room or attic, dont you have to clear out the mess at the front before you get to the mess at the deeper end? And is it not true that the mess near the entrance is the one that was placed more recently than the one that is at the far deeper end?

I think its 60 days past an RFE not 60 days pass the NOA1 for an expedited request to look at your file again. I might be wrong, but I understood new policy at USCIS was a 6 month window from NOA1 to NOA2. Can anyone else can add here to clarify?

I dont think USCIS are dumb enough to violate their own laws. They do not promise to process an application within any number of days either of NOA or RFE. Though they have guidelines to call them if you have not heard from them, say 30 days since you sent an RFE. A few months ago they promised to process ALL applicatiosn within 6 months, but I think the USCIS director who made that promise has left USCIS.

It's not fair that those who applied in March/April/May are still waiting for an NOA2 and others apply in September and are approved in October.

Both my NOA1 and NOA2 say if you have not received the notice or heard from this office 60 days form this notification, contact the USCIS or NVC. Once outside the 60 dyas and they have not taken action, I'd be filing expedite request. They have to deny or approve the expedite request or at least respond to it. If you receive the standard polotical we are gettign to it answer, contact you congressman.

As far as the USCIS skipping petitions prior to the IMBRA law and new 129 forms, I think it stinks even though we are one of the Sept NOA2's. It might be as simple as the USCIS processing all the RFEs that had to be sent out for petitions filed before the new 129 form including the IMBRA RFEs. Either way it is unacceptable. Again, I say write you congressman and file an expedite request if you have been waiting since Mar/Apr. It has already worked for one member in VJ. Good luck, Payato
