Initial Review

On September 29, 2011, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

This has not changed since sept. 29th. I have called plenty of times and they tell me to just be patient and wait it out. I just had a Newborn daughter on Jan 23rd and I want to be with her soon. I am getting very impatient with this. I am scared that if I leave they will approve it and i must be back very fast.

Then on 5-04-12 i called customer service and there was a really nice lady and she told me that they are out of normal processing times and she sent them a message saying that and i got a reply from them.. it read

On 05/04/2012 you, or the designated representative shown below, contacted us about your case.

Type of service requested:

-- Outside Normal Processing Times

The status of this service request is:

Your case is currently under pending review. You should receive a notice of action* within 45 days.

*A notice of action may be in a form of Approval Notice, Denial Notice, Transfer Notice, and Request for Evidence, Notice of Intent to Deny or Notice of Intent to Revoke.

its been 30 days and no reply.. and its been 8 months since they have recieved my I-130.. what happens if i leave the country? and any advice? thanks in advance

Wow, I'm so sorry for your situation. Have you gotten in touch with your local congressman's office yet?

The fact that they finally actually even considered a service request though is a good thing.

No i have not contacted them yet.. do you think thats a good idea? even waiting after the service request?

I would contact them every 30 days if the processing time is outside of the normal process. Incidentally, I went out of the US and is now in the Philippines to await my results whatever that may be. I changed my mailing address to my new location in the Philippines and today I received a notice from the USCIS acknowledging the change of address. I did this because I have an FPO address overseas for receiving and sending mail.
