Your divorce papers were CORRECTLY made out as Jones vs Jones as that WAS your name at the time you applied for it.

Youare still Jones until you remarry - unless you legally cahnge your name by deed poll - but why bother? You can CALL yourself whatever the heck you like but your 'official' name (sans deed poll changes or remarriages) is still Jones although you are 'known as' Smith..

The emabassy / USCIS ought to be able (ok I know I'm tempting fate here, lol) to work it out as they will have copies of both your decree absolute AND your birthcertifcate.

If they get confused they'll RFE you to explain.

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

Don't get me started on the birth certificate phalava. My birth certificate is lost, cannot be found or traced and so I will require affidavits from my parents to verify my date of birth etc. I have however, sent along with my Decree Absolut my British Citizenship certificate with my (maiden) name and DOB on.

But that's really helpful and might just speed up my K1 process a little more At the moment I've been waiting for my name change to come back.

2nd March 2006 - I-129F Sent

13th March 2006 - NOA1 & Cheque cashed

30th June 2006 - Received RFE re IMBRA

3rd July 2006 - Mailed RFE to CSC

4th July 2006 - Touched re RFE

5th July 2006 - Touched

18th July 2006 - Touched confirmed receipt for RFE. #######?! I know they received the RFE on 4th July!! Skanks!!!

17th August 2006 - NOA2 finally!!!

11th September 2006 - Package 3 sent to US Consulate (DS-230 part 1, DS-156, DS-156K)

8th October 2006 - Sent checklist to Consulate to confirm that all documents are available for interview

13th October 2006 - Medical (11:30am) - Friday 13th Aaaaaaaaaargh!!!

7th December 2006 - Interview at 10am

7th December 2006 - Consular requested "Proof of non-existence of birth certificate"

15th December 2006 - Courier picked up "Proof of non existence of birth certficate" - what I did? I contacted my lawyer in Vietnam and asked him to search for my NON-EXISTENCE birth certificate and had him write an affidavit of his finding. What a waste of time and money!!

22nd December 2006 - K1 Approved. Finally!

Has anyone encountered this situation.....the surname on the Decree Absolut is the married name instead of the maiden name.

Basically, when the divorce was filed, it was filed as "Sacha Jones versus Steven Jones" instead of Sacha Smith (maiden name) versus Steven Jones. So obviously the Decree Absolut came back as Sacha Jones, which is all fine until....

My fiance started the application for my K1 visa where the name we used on the application was Sacha Smith (maiden name) instead of Sacha Jones. And having sent alone with it, the Decree Absolut which said Sacha Jones, I believe they may require some proof that my name has officially been reverted back?

I have applied to have my name officially changed back to my maiden name (via UK deed poll), but can you tell me whether this is necessary for the application?

Thats a good point! I also have the married name on the decree absolute but then again I havent reverted back to my maiden name I have kept my married name as at the time it was alot less hassle to go around changing the name on accounts etc. ON the K1 application I wrote down all the names i was using inculding my maiden name so I guess it should be ok. I didnt know we had to change back to our maiden name via deed poll?? I thought you just show your decree absolute to organisations such as banks , passport office etc to show that you are divorced and wish to use your maiden name.

There is NO NEED to make a change by deed poll unless you want to.

Legally you can call yourself by any name in the UK as long as you inform people like banks, NI offices etc. Your 'official' name will remain the one it was before any legal changes (like divorce) until you remarry as far as institutions like Immigration and passport offices are concerned (unless you change it by legal document like a deed poll).

I kept my previous married name soley because it was easier and it's going to change legally when I re-marry anyway - I will wait until then to start changing pasports etc - remember IF you change your name by deed-poll you would be advised to also get a new passport in that name or your documentation will not match name wise, and that may cause confusion at the service center.
