My wife and I have been having a hard time recently. I have a few issues I need to work out on my end but their are some other things where I and my family feel I am being manipulated.

So I have contemplated the following - She does not have her Green Card yet - is their any way to call up USCIS and ask if they can delay issuance of the Green Card (not withdraw my support as Fiance) ? I already know that the answer is probably "No" but I thought I would ask.

My main concern is the affidavit of support and how that could be used against me in a divorce by someone who loved me but is now very angry. (alimony)

If we divorce after the Green card I am then potentially liable to pay alimony because I signed the affidavit of support ? I really do not want to get to scared about these things but some advise would be appreciated.

My hope is to work things out - but the potential legal ramifications of marriage make marriage pretty hard at times.

hey june 4th..

u should really think about it what u wanna do about ur marriage. maybe u can talk with her about some issues..

the option u have is that u can pull ur affidavit of support and dont come to the green card interview then its gonna get denied for her.

did u read the guidelines for the affidavit of support???

please read that. u obligate to support until the immigrant becomes a citizen or has 40 quarters of work. divorce does not end the sponsor ship.

You could withdraw the affidavit of support which would stop the green card process. This would allow time to attempt to resolve matters between the two of you. You could always refile AOS later although there might be some questions as to why you withdrew support the first time.

"(not withdraw my support as Fiance)" <-- Aren't you married? You would be withdrawing your financial support as her spouse and sponsor.

Why get married in the first place if you are so afraid of the legalities that go along with it?

The I-864 is not used for alimony. It is a contract between you and the government. It is not an alimony contract. She can ask for alimony in a family divorce court with or without the I-864. It would be up to the judge to grant it or not.

You can withdrawal your affidavit of support anytime before she is approved for her green card. This means her AOS will be denied.
