It's very easy to say. And certainly some of the people bringing over fiances from overseas are acting irresponsibly. For sure. Some of them just fell in love with the idea of an exotic woman from another place. Maybe when that other person got here, things just weren't the same. Unfortunately, the circumstances of these types of relationships often don't allow a lot of time together in person. I mean, think about it, many people here maybe have only met their fiance for two weeks or so, and that's it. Then you are expected to marry within 90 days....

And yes, the sad truth is that many people from poorer countries have a strong desire to get to the USA, or a richer country. Even if sometimes that doesn't mean they commit fraud (although I'm sure that happens too) some of them are just blinded by the idea of a much better life. Then maybe the reality of living abroad sinks in.

But it's not fair to only blame the petitioners.

Yeah, it's hard to always read those threads and wonder what those people are/were thinking. It's hard for me to pass judgment though because we don't know everything that is happening with the couple. I'm glad that I've had the opportunity to live with my fiancé for over 1 year. Living with someone and dating someone (foreigner OR from your home country - it's true for both situations) are totally and completely different things, IMHO.

No. The visa is not intended to grant people a trial period with their partner or in their new environment. It's to make wedding plans and settle in a bit. This isn't a "see how this works" visa. It's a visa intended for people who have already made the decision. I'm so tired of reading this here on VJ, people who think the K1 is actually intended as a 90 day test drive.

The visa isnt granted to make wedding plans. That can be done from anywhere. The immigrant knows little of planning weddings in the USA anyway & would probably prefer to marry in their own country. Settle in a bit? In many cultures its a huge break in tradition to settle in before a person marrys. The immigrant is at times thrown into a unique situation where I would think a " test drive " would help.

I personaly know a few women that came here only to decide they made a mistake. They had no plans to marry as far as I know. Keep in mind the visa is granted to people that may have met only once in their lives. A test drive is exactly what may be the best way to find out of the couple is compatable in a real life situation.

This is a difficult subject so you may need a nap as if you tire easily.

Why is it that everytime I turn around I see someone bringing a person over to the states on a K1 visa and then decide not to get married. Although I am a US Citizen I hate the fact that this is happening. People you need to make up your mind before making this commitment and spending all this money. Must be nice to have money to play with. Even more playing with peoples emotions and dreams. I am well aware that everyone does not come over in all honesty, but those that do and left to believe they are loved by the person who petitions for them to only be left in a bad situation. I feel sorry for those that come here have no family or friends only to be told I DONT WANT TO GET MARRIED ANYMORE so I guess you will have to go back. Why could you not figure that out before going that far!! Some people come from really bad living situations and really dont want to go back. There was enough love to start the situation! Geesh I just dont know what to say. Just to clarify I am married to a wonderful man from another country. We have been married for more than a year. I am glad I did not file for him till 7 months later because it made me even more sure to want to be with him and to be with him more in his environment.

I am agree with you, before I read you post, I was reading another post from a lady who cam with K-1 and now fiancee does not want to marry her. After, she left everything behind. It is not fair. :thumbs: :thumbs: :thumbs: :thumbs: :thumbs: :thumbs: :thumbs: :thumbs:

K1 is a fiance(e) visa right? so typically, to be a fiance(e), there has been an understanding, a question or an agreement to make plans to get married.

I think its 90 days, because its unrealistic to say.. 'you must get married in 10 days after POE'. Same thing as being given 6 months from the time the visa is issued to enter the US. Its being realistic.

I believe its the responsibility of both parties to make sure that this is the right path for them.

I agree that the K-1 is to bring your fiance here to make plans for your wedding, not a trial period to see if you like it or not. However, I do see where people can get their information saying it is a trial period. I found the following statement here on VJ in the guides section under K-1.

I don't agree that it should be interpreted that way because I feel people should definitely know that they want to get married before they ever file the petition. So many of us desire to be married with our fiances and are waiting and waiting. I personally can not imagine going through all the processes and waiting for someone I was not certain I wanted to spend the rest of my life with.

If they came here on a K-1 with no plans and intentions to marry, then they lied to get the visa. They signed letters of intent stating they intended to marry within 90 days of entry to the US. Also, if they wanted to get married in their own country, then the K-1 is not the right visa path for them. They should get married in their country and have their USC spouse file for a spousal visa instead.

The K-1 visa is not a 'get to know you' or 'test drive' visa. The 90 days are not so you can date and decide if you wish to marry or not. You are supposed to already know one another, be engaged and have the desire to marry in the near future. The K-1 allows a foreign fiance(e) to enter the US and fulfill their plans of marriage within 90 days of entering the US. The 90 days is given to get married. They figure 90 days is plenty of time to get the marriage license and finalize wedding plans. They are not given so you can get here and then decide if you even like the person or want to marry at all. That is not the purpose of a K-1. The K-1 visa is good for 6 months, so they also have that time to decide if they really want to enter the US and go through with their wedding plans. Perhaps get another face-to-face visit in there if they have only met once in person and still have not decided if they are compatible enough to wed(but by the time they went through the K-1 visa process and were approved, they should know already). Getting married is a serious decision that should not be taken lightly, no matter what country the person is from.

Then you know people who lied to get a visa. Letters of intent are mandatory for a reason.

Visits are for test drives. If you don't know for sure that you want to marry the petitioner and live your life in the US then this visa is not for you.

People abusing the system and using this visa for unintended purposes are the reason this process can be so ridiculous.

They didnt lie as far as I know. They intended to marry but didnt have concrete plans to do so before they got here. They were granted the visas by the embassy just as everyone else is.

The law indicates people must have met in person once. That is hardly enough time to get to know someone well enough to decide to marry them. I would agree the system is flawed but it serves to bring many people here to decide what they really want to do.

there is no guarantee in life so get over it. if things dont work out they dont. every day its happening to ppl that live here so why it wouldn't when you have ppl from different countries getting married?? When you bring someone over on K1 visa its not a contract to marry them. Otherwise the waiting period would be 1 day.

As for the scammers well they totally deserve being kicked out of the country. of course half of them will stay anyways.
