how? She hasn't done anything that would result in a lifetime ban. Please expand on your reasoning rather than making broad statements designed to scare the OP.

This exact reason is why many believe that K-1 visas should cease-to-be. The very set up is designed for fraud on both parts. (We used a K-1 because at the time, it seemed to be just as easy as a spousal visa and getting married in my other half's country takes more time than I had available to take off from work.)

Foreign fiances can be used for 90 days labor and/or a sex toy, or told to pay up or be descarded (This happened to someone I know. He was from the Mid East and when he told her "NO", she called Homeland Security and claimed he was a terrorist. Try adding THAT to USCIS difficulties. )

The USC fiance can be used just for a greencard and then discarded once the foreigner is legal, that person can divorce and then begin working towards the process to bring over his/her "real" fiance.

It works out for most of us, but there are so many cases of abuse and fraud that I am also one who now fully believes that we should not have K-1's an options whatsoever anymore.

I wanna answer the question why he does not want to marry me. he is a millionaire, he is working for 18 hours a day with no day-offs. I almost dont see him, 10 minutes a day but he says he loves me most thats why Im still staying at his place. After one month I have been here he said that I am a wonderful girl and he loves me. but if to ask him will he marry me, he said that he wont. As I realized he needs a woman who can run his business as well as he does. im trying so hard, I started to run his italian restaurant at Myrtle Beach and it seems like he starts to like things the way they are but still he does not talk about wedding. He said before that in the end of June we will make a decision. or I leave, or we get married. Moreover we got a big difference in age. Im 21, he is 48.

And I wanted to add...I dont wanna marry another person, I love my fiance. If I cant marry him, anyway I wont stay, I will go back home because I respect american laws. Honestly I never wanted to live in the USA, I came in here just because of my fiance, he said that he loves me most and I did believe and still I do believe because he keeps saying this while doesnt show it...

If you have no intentions marrying someone else, why would you even ask?

I would just go back home and move on with my life .... Sorry lady, but you don't sound legal at all. Hard to believe, you wanna marry out of love after reading the opening of our post!

I'm troubled by the mean-spiritedness of some of the comments. Where's the compassion? Perhaps her English is very basic, resulting in messages being lost in translation. I doubt she is planning to lead a life of crime here.

Although the sad truth is that K1 must either lead to marriage or a return to one's country, I truly wish her the best. She came here to be with her fiance, and that wasn't easy to do. Now she has to deal with his cold feet and what looks to be the breakup of her relationship. She's looking at a long flight back home with a broken heart. Why pile on?

Because the anonymity of the internet allows people to be malicious in ways they would not dare do in public. They would be stealing too if they knew they wouldn't be caught.

Yes. We should all give her the best advice possible. Compassion is important. However, she does need some perspective. A dose of reality, so she doesn't put herself in such a terrible situation in the future. The fact is that she hoped to marry a man (who just happens to be a millionaire) and is 27 years older than her. It does not seem likely that these factors would cultivate a healthy relationship (for either party). It seems like a very unusual situation. It will not end well.

Yep, my wife still think we're applying for my "citizenship" or something to that effect, no matter how many times I try to explain her the difference between PR and citizen.

Most of my US friends are still scratching their heads at the fact that I didn't "automatically become a citizen" once I married an American.

Since most Americans will never in their life have to deal with the USCIS, taking advice from an average person who's advice is "there's always a way" is a really bad idea when it comes to immigration.

Precisely! I personally wouldn't put my fate in the hands of someone without experience or knowledge about these things. "a friend told me" isn't going to fly when you're being deported because of an advise your friend gave you.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

Of course you would say to get rid of K1 since you already got yours.

I can provide you with the same "dose of reality" just by mentioning the Ukraine is about the highest green card scam country there is. I can question the language, culture, and if I have background on both of you just comb through each of you selectively and be a judgemental holier-than-thou ####### about saying you are wrong for each other. But I just don't have it in me. I have a black half-brother, a sister is a converted Jew, Muslim neighbors on Mindanao, we have very good friends from cultures with arranged marriages, some of our family is filthy rich and I mean filthy rich. A cousin is a starving artist, we're in a log cabin in the woods, another cousin is gay - so what. We don't judge people and look for things to invalidate them or their relationships. Oh my GOD you're both MEN!! Men can't love other men! Pffft.

The only matter at hand is the guy does not sound like he wants to marry her. He should be foaming at the mouth to get down her pants and want to live with her forever and ever. All the other judgemental stuff is irrelevant. I'm 30 years older than my wife and people who actually see us don't think a thing of it. The only people who say anything about it are malicious anonymous internet posters, and it says a lot more about them than it does about us. It never even occurred to me that it should be an issue when I was young. So what. It isn't my business who loves who, nor do I care. But I do care about people who are attacked for what they believe, the color of their skin, their handicap or age or whatever. Because that is being a bigoted bully, and it is actually unlawful to discriminate against any of that in marriage, employment, etc.

So you can say oh yea, it may be LEGAL for blacks to marry whites but it sure looks bad - oh how revolting to know a white woman is being touched by a black or a young woman touched by an older man or a dirty Jew/slimy Muslim with a Christian, etc. etc. That kind of bigotry is what I find offensive.

Very. The age difference alone is enough to take pause. I think I've gotten a pretty good perspective on Ukrainian culture in the years with my fiance. It can happen, but it's really not that common. Not at all. And when you factor in all of the other things with the story..yikes.

Such an age difference is not common but is culturally more acceptable in Ukraine and Russia than the USA. I'm 49 and Alya is 28 and we have a great relationship. I'm not a millionaire but she makes me feel like a million bucks. biggrin.gif Hmmm a millionaire who works 18 hours a day with only 10 minutes to see his fiancée. That seems uncommon to me. whistling.gif

Bottom line if he doesn't want to marry then you will have to leave. No options no exceptions.

Don't let what you cannot do interfere with what you can do.
