Whomever advised you to get your fiance to change his mind obviously is not a qualified marriage counselor. If you two are not in love, then you should not marry period. It is better to be happy in your own country than unhappy in another country. It is possible that you can still go through the K-1 process with the right person. Find the right person. The many people who advised you to leave the country within 90 days are all looking out for your best interests. If you do not obey the law, then you will not have another chance in the future to come here or stay here legally.

Hello guys,

It seems like I got to be in a very sticky situation, and I need your advice, please. I am already in the USA for almost two months. I came here using K1 visa. I know we should get married within 90 days after my admission but it happens so that my fiance doesnt want to get married. I got only one more month in here, and then I will need to leave the country, or it is better to say I should leave it by law. I have read a lot of articles about k1 visa. It is very strict and there is no options to stay in the USA if you dont get married to the petitioner. I wanted to ask you, maybe someone went already through the same...if I get married another person, not the petitioner, but the US citizen as well, what will happen? How much difficult is it going to be for me then to become a legal? I mean to get a green card, or any paperwork that will allow me to stay? Does it work at all, or no? For me to stay illegal is not the option but still I need to know whatever I could do and find the best way to work it all out. Because at this very moment I dont think that my fiance will marry me but still...we get one more month that possibly could change it.

..you should leave the counrty and if you are planning to marry somebody else then go back to your country and he must do the same thing as your current petioner did! but it will take a long long time because you will go back to ZERO..but anyway who knows your BF might change his mind and marry you.wish everything would be alright.

2. whatever happens married or will not get married to the petitioner.. you MUST FOLLOW THE RULES of US LAW, that's PERIOD!

Yes. The whole thing doesn't make any sense. It's clear that the petitioner's intentions were less than serious. As though it was a test run of his "potential bride." There's no love in that. But honestly, I don't think any of us here will ever be able to grasp the situation in its entirety. It's impossible for us to ever know enough about both of the parties involved. But I think it would be rare to find a 48 year old millionaire that was very serious about marrying someone 27 years his junior. Honestly, they have so much to lose if things were to not work out. The relationship as described here just doesn't sound healthy. And the petitioner was already breaking the law by using his "fiance" to work without completing AOS. Unfortunately for the beneficiary, there is no option other than to go home. Even if they were to get married, there's a 2 year rule as well. If the marriage occurred but then dissolved before those 2 years, some big problems will still occur on the path to citizenship. It's an impossible situation. The K1 is a very strict Visa. It's really not designed for this sort of thing. Hopefully things will work out for the beneficiary and she can return home safely. It's so very important with the K1 visa to marry for love. love and love alone. There are mechanisms in this process designed to prevent people from exporting themselves to the United States or for a petitioner to bring a woman over here without serious intentions. Because this process is extremely hard and it really does not get easier for a very long time.

Amen to that...I would love to have the opportunity to marry my fiance as soon as possible. Instead I'm stuck in USCIS limbo...

The whole system is crazy. They need to re think what their definition of "bona fide" means. I hope silly games like the one here doesn't delay mine and my fiancés petition, or any other true legit bona fide currently waiting.

I agree story is a little weird you came here to marry to work in his restaurant but never wanted to come to the US like make up your mind on what BS you want to give

The good news in all of this (if there is any) is that if he does not marry you and you do what is right and return to your country, and do not over-stay then this will make you look good for future Visa's to the USA. My Ex dated an Englishman and South African. She visited their countries and never over-stayed. When I applied for her a tourist visa to meet my family she was granted a 6 month Visa to USA.... Since our break up she met another American and now got a 10 year multiple entry Visa to USA. Her home country is Philippines which is never easy to obtain a Visa from. So if you do what is right, you have a great chance of getting approvals in future Visa's if you choose to come back.

Sorry to hear of your struggles. There is light at the end of your tunnel. It just may take time to reach the light if you do what is right and don't over-stay.

Regardless of this, as everyone else has posted out you must marry or leave the USA. Please also don't forget that one you marry, you and your spouse will need to file for adjustment of status which is in excess of a thousand dollars. Two years later you would need to apply to remove the conditions. You cannot marry someone else and remain in the USA and as another person has posted, if you were to marry someone else and leave the USA to file for a spousal visa this would be looked at as visa fraud and you would need to prove that you married with honest intentions which it does not sound as though you are. This would lead to denial, and if you remain in the USA, it would lead to deportation.

If you remain in the USA and do not marry your K1 will expire, you will be out of status and therefore you will be in the USA illegally. You will be subject to deportation since there would be no legal way for you to remain in the United States without leaving and re-filing for a K1 or spousal visa. You will not be able to work or file for any form of work permit. It's likely that if you were to refile, you would be scrutinised far more closely since you failed to marry the first time around. Again, this may appear to be visa fraud to an immigration officer and would likely lead to denial.
