Hello guys,

It seems like I got to be in a very sticky situation, and I need your advice, please. I am already in the USA for almost two months. I came here using K1 visa. I know we should get married within 90 days after my admission but it happens so that my fiance doesnt want to get married. I got only one more month in here, and then I will need to leave the country, or it is better to say I should leave it by law. I have read a lot of articles about k1 visa. It is very strict and there is no options to stay in the USA if you dont get married to the petitioner. I wanted to ask you, maybe someone went already through the same...if I get married another person, not the petitioner, but the US citizen as well, what will happen? How much difficult is it going to be for me then to become a legal? I mean to get a green card, or any paperwork that will allow me to stay? Does it work at all, or no? For me to stay illegal is not the option but still I need to know whatever I could do and find the best way to work it all out. Because at this very moment I dont think that my fiance will marry me but still...we get one more month that possibly could change it.

Yes unfortunately you only have two choices to be legal. You must marry the person who petitioned for you to come over, or you must leave the country.

ANY other action will result in your being illegal, and then you would never get a visa to come back. If your goal is to someday live here, you MUST leave the country. I know it's very hard, and sorry to say. But you cannot simply marry someone else.

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

Carolina, there are no grounds for you to stay in the US legally. Your visa to the US was granted upon the condition that you marry the petitioner. If you are no longer getting married you will need to return to your home country. Getting married to someone else for the only purpose of staying in the US is against the law.

Unfortunately for you there is no recourse.

Your boyfriend must be seeing a personality issue that you failed to mention. Why does he not want to marry you? Does he feel that your values are lacking? Maybe he believes you have not been sincere and you only wish to get a green card at any cost such as trying to find another man to marry so you can stay in the USA. As others have stated, NO CAN DO!

You can not stay in the USA if he does not want to marry you! You must return to the Ukraine! No options. The good news is he should pay for a ticket for you to get back to the Ukraine.

Not only must you get married, second step is you must Adjust Status, to get the green card. You can only marry the person who sponsored the K-1 or go home. There is no other legal option to stay. Sorry to hear you found yourself in this situation. I sure wish people knew each other better before they sponsor someone or leave their home country to come here. Sadly situations like your's are much too common.

Every one is correct, you must leave the country. However, what no one has pointed out is that there is nothing to prevent you from marrying someone else, while you are here. Then, that person could file for a spousal visa for you, and you would be able to come back and be with them in about a year. I am not suggesting this as an approach, just mentioning the possibility... Good luck, and sorry that your relationship is not working out.

I wanna answer the question why he does not want to marry me. he is a millionaire, he is working for 18 hours a day with no day-offs. I almost dont see him, 10 minutes a day but he says he loves me most thats why Im still staying at his place. After one month I have been here he said that I am a wonderful girl and he loves me. but if to ask him will he marry me, he said that he wont. As I realized he needs a woman who can run his business as well as he does. im trying so hard, I started to run his italian restaurant at Myrtle Beach and it seems like he starts to like things the way they are but still he does not talk about wedding. He said before that in the end of June we will make a decision. or I leave, or we get married. Moreover we got a big difference in age. Im 21, he is 48.

And I wanted to add...I dont wanna marry another person, I love my fiance. If I cant marry him, anyway I wont stay, I will go back home because I respect american laws. Honestly I never wanted to live in the USA, I came in here just because of my fiance, he said that he loves me most and I did believe and still I do believe because he keeps saying this while doesnt show it...

And a lot of people here (I mean Americans at this town where I am) tell me to stay, that there is always an option, this is America, everybody has a choice, and I dont need to leave. But thats not true. At least in my situation. I know that but they keep confusing me. and I dont wanna make mistakes. The United States is a beautiful country, and anyway I have to follow the laws. because this is a right thing to do. Its simple.

hmmmm...sounds a little fishy to me, but who am I to judge. You provided two stories, or posts that contradicts itself. But case in point, you dont get married...GO home.
