Are you sure you are prusuing a K3, if so a K3 is a mulitple entry visa for 3 years, so you could leave one day and return back to home country the very next day.

Now, if you are pursuing a CR1, again when you arrive in the US it will activate your temp GC status, with that you can arrive and leave back out within 24 hours.

So either of these can give you some lead way in time for the permante move.

You won't be getting a K3 visa, you'll be getting a CR-1 visa (IR-1 if you've been married over 2 years when you enter the US).

You'll receive the visa within a week or two after the interview, and you don't have to enter the US for another 6 months, as long as the medical and police certificates are still valid.

How sure are you in stating that she will not be receiving a K3?

Typically it is 6 months, but check the visa when it is issued and there will be an expiration date on it, you must travel before that date

Good luck

Positive. No one gets K-3s anymore. It's obsolete. The poster you refer to in the link never confirmed it was actually a K-3 he/she got. I suspect it was a CR-1/IR-1.

The validity on the visa after approval is 6 months . What I find interesting is that everyone says the K3 is obselete, but I have had 3 separate appointments with 3 separate immigration officers over the last 4 months with the most recent 3 weeks ago and all 3 instructed me to petition for a K3 visa. I know that there are links stating this BUT I chose to go with the advice of 3 different immigration officers. Good luck with your interview

That is because your attorneys have no idea what they are talking about, which happens quite a lot. Drop your attorneys and go CR-1 route.

Actually, the validity of the visa depends on the consulate and the timing of the medical. To say a blanket statment of 6 months is inaccurate and misleading.

oh, and were your 'immigration officials' lawyers? paralegals? people on USCIS phoneline?

Good luck

What do you mean by Immigration Officers?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
