I've just had my K1 fiance visa approved and I'm going to go to the US in late June. We're not getting married until 2nd September, but I want to be able to work as soon as possible. I realise that I-765 is free if submitted with the adjustment of status, but I'm willing to pay the $380 and submit I-765 as soon as I arrive in the US if it means I can work sooner. However, I've read on some websites that the USCIS won't process I-765 until the adjustment of status has been submitted. Did anyone submit a I-765 before their adjustment of status? Did it come back after the normal 2-3month waiting period? Or did it take longer? Anyone's prior experiences would be greatly appreciated!

It takes the normal processing time when you file before AOS and it expires the same day as your I-94 entrance card. So 90 days after entry your EAD you payed 380$ for will be expired and you can no longer work.

People choose not to do this because it ends up a waste of 380$ as the EAD is usually not issued until its almost expired anyways.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

hi there :) hmmm...as far as i know once you get here in the US your main priority is to get married with your fiance within the 90 days period..im not quite sure if you can already file the I-765 ahead of your I-485(aos) because, as far i know sweetheart the AOS is somehow connected in any forms which you need to file like I-765..correct me if im wrong,coz i filed for aos and I-765 and received an RFE(request for evidence for my aos but the letter that i got says that they cannot process my I-765 unless i give them the RFE for my I-485 so i would suggest it would be better if you just wait til you were able to file your aos and I765 together to avoid any delays or any problems with your application,i hope i helped you a bit with your inquiry..but take note..im not sure if you can file for I-765 already without filing your aos yet since this is the first time that ive ever read this kind of post anyway God Bless and take everything slowly,everything will fall into place in God's time :) good luck!

As Inky stated it takes the same amount of time as filing it with AOS 60-90 days although unlike the EAD you get with AOS, the EAD based on K1 is valid only until your I-94 expires. Given your I-94 is valid only for 90 days. TOTAL waste of money.
