Hello Vjers,

Wishing you all that are waiting one thing or the other success!

My wife the USC is in States to get essentially her domicile re established to ensure that she meets up the requirements to sponsor me her husband. My 1 -130 petition was approved recently entitling me an Immigrant visa.

??????????????Again regarding taxation.

1. Is advisable to jointly file her tax returns? We are married for over a two years.

2.What requirements should she need from South Africa to enable the supposed joint filing?

3.Can she be assisted at IRS offices or do we need to hire a Tax practitioner in States?

4.How long does it take to get a transcripts of the ought to be submitted joint filed returns?

I will so much appreciate your contribution to the questions above.

There is no need to multiple post....it just tends to confuse things.....

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

If you do not have an SSN already she needs to file ITIN for you so she can file joint taxes.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Is it advisable to jointly file considering that the years she is liable to file return are years that we are in marital union

Joint return usually gives more money back. She could get a higher return rate if she files jointly.

If she has someone do her taxes for her generally they can do joint papers and married separately papers to see which will give more money back.

But if you are married you must file taxes married.

Joint return usually gives more money back. She could get a higher return rate if she files jointly.

If she has someone do her taxes for her generally they can do joint papers and married separately papers to see which will give more money back.

But if you are married you must file taxes married.

Thanks for your reply.Her income to use in filing the returns are foreign based which is below the threshold to pay US taxes, so do you recommend that we file jointly?

Immigration issues aside, it is probably financially advantageous if you file a joint tax return, particularly if your personal income falls under the foreign excluded income limit.

Thanks for your reply.Her income to use in filing the returns are foreign based which is below the threshold to pay US taxes, so do you recommend that we file jointly? We are living in South Africa where all our income falls under the foreign excluded income limit.
