Hi

I received a letter requesting initial information. It says please submit a completed and signed form I-864 for the petitioner/sponsor listed on form I-130 or form I-129F

My husband is my petitioner, but he hasn't worked before, he was a full time student, he recently got a job but won't be able to submit his taxes until next year.

My question is, what information are we supposed to put on the tax info requested in the form I-1864 if he didn't submit any taxes?

We submitted that form with a joint sponsor, but didn't send one for my husband.

What information or documents do we need to send with that form they are requesting?

Thanks in advance!

Your husband still needs to fill out i-864 form as your petitioner even if he makes zero and you have a joint sponsor.

You can put zero as his income and include and explanation that he was a full time student, had no income, and therefore was not required to file taxes.

The spouse is always the primary sponsor and must fill out an I-864, even if they have no income. Do not put 0 on the lines for #25 though. Put something like N/A - NOT REQUIRED TO FILE. He will include a statement explaining that he was a student, did not not work, had no income and therefore was not legally required to file taxes.

Thank you so much, for your reply!

Do we need to include any other documentation with the form I-864 like school transcripts or the taxes his mother filed where he's included??

Not really. You can include his school transcripts to go along with his explanation of why he was not legally required to file taxes if you like, to prove he was a full time student, but I do not believe they are absolutely necessary.
